A new class action lawsuit alleges Zillow tricks consumers into using its agents and charges undisclosed fees as part of a scheme to unlawfully drive up home prices.
Plaintiff Alucard Taylor’s class action lawsuit claims Zillow effectively forces home sellers and their agents to post a listing on its website immediately after advertising the home for sale.
Taylor argues Zillow’s policies and conduct then increase the purchase price of homes for buyers and incentivize Zillow’s agents to prioritize receiving their full commission at all costs, even if the buyer loses the bidding process.
“The effect of this policy is to inflate the unjustly earned profits Zillow receives from its deceptive conduct, as it continues to increase its dominance of the market,” the Zillow class action lawsuit claims.
Taylor wants to represent a nationwide class of consumers who purchased a home listed on Zillow.com and were represented by a Zillow agent between Sept. 19, 2021, and the present.
Zillow’s scheme has intent, effect of unlawfully maintaining high, inflexible commissions, class action says
Taylor argues Zillow’s scheme has “the intent and effect” of unlawfully maintaining high and inflexible commissions that drive up the prices that buyers must pay.
“Zillow engaged in patently unfair and deceptive behavior and obtained a windfall of ill-gotten gains as a result,” the Zillow class action lawsuit states.
Taylor claims Zillow is guilty of unjust enrichment and in violation of the Washington Consumer Protection Act and the Real Estate Settlement Procedures Act.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, treble and punitive damages for himself and all class members.
Zillow agreed to settle a separate class action lawsuit earlier this year that was filed against it over claims its StreetEasy platform charged agents daily fees even after their listings were no longer available.
