YoPlus Yogurt Class Action Lawsuit Certified

The YoPlus class action lawsuit claims General Mills engaged in deceptive and unfair conduct in violation of California law by advertising that its YoPlus yogurt products provide digestive health benefits that plain yogurt does not provide. These alleged false advertising claims allowed General Mills to charge more for YoPlus versus other yogurt products, which negatively impacted consumers.
General Mills denies the allegations and claims that its digestive health claims about YoPlus yogurt are true and supported by scientific evidence, and that not all purchasers paid a premium for the product. The Court has not decided who is right or wrong, and has set a jury trial for June 5, 2012. The Plaintiff is asking for monetary compensation for Class Members, as well as injunctive relief requiring General Mills to change the advertising for YoPlus yogurt, but there is no guarantee that a class action settlement will be reached.
