A Wisconsin couple has recently filed a DePuy ASR lawsuit, adding it to the growing mass of litigation against DePuy over serious complications from its device.
The plaintiff, Jerry R., was implanted with a DePuy ASR hip implant in his right hip back in September 2008. However, he soon began to suffer from serious complications because of the defective implant, the DePuy ASR lawsuit claims. Indeed, according to the lawsuit, Jerry suffered from physical injury and bodily impairment as a direct result of his implantation with the DePuy device—despite having received no adequate warning about this possibility, he claims.
As a result of these injuries, Jerry was forced to undergo hip revision surgery years later, in August 2017. This extra surgery, of course, brought new risks as well as medical expenses to the table.
Jerry then chose to file a lawsuit against DePuy in response. He claims in the DePuy ASR lawsuit that he suffered injuries and economic loss due to a defect with the DePuy hip implant.
Jerry filed this DePuy ASR lawsuit on multiple counts, including negligence, defective design, failure to warn, fraudulent misrepresentation and concealment, negligent infliction of emotional distress, punitive damages, and medical monitoring. Jerry’s wife Dianne also filed on one count of loss of consortium.
The DePuy ASR Hip Implant
Hip replacement surgery is one of the most common surgical procedures—each year, thousands of Americans are implanted with hip replacement devices. A large portion of these implants are metal-on-metal devices, like the DePuy ASR hip implant. The DePuy ASR device is a popular option for many patients seeking a hip implant.
Despite the popularity of the DePuy device, a growing number of patients like Jerry that have been implanted with a DePuy ASR implant are coming forward with complaints of serious complications. So far, DePuy has been hit with thousands of lawsuits over injuries linked with its ASR hip implant.
The U.S. Food and Drug Administration (FDA) issued a recall of the DePuy ASR hip implant in August 2010, after receiving countless reports of serious complications linked with the device. The recall affected around 93,000 devices.
Filing a DePuy ASR Lawsuit
Nearly 8,000 DePuy lawsuits like Jerry’s have been filed over the hip implant device in total. Some patients who have been rewarded with a DePuy ASR settlement have received settlement awards in the hundreds of thousands of dollars—in fact, the first group of lawsuits reached a DePuy ASR settlement of $600,000.
If you or someone you love has experienced complications due to a metal-on-metal hip implant from DePuy or another company, you may be able to file a DePuy ASR lawsuit. Of course, filing a DePuy ASR lawsuit cannot take away the pain and suffering caused by device complications, but it can help to alleviate the financial burden from medical expenses and lost wages.
The DePuy ASR Lawsuit is Ress v. DePuy Orthopaedics, et al., Case No. 1:17-dp-20050-JJH, in the U.S. District Court for the Western Division of the Northern District of Ohio.
