Consumers who previously sent an email from their non-Gmail account to a Gmail account may have had their emails scanned, potentially qualifying them for a Gmail privacy concerns lawsuit.
If you are a Yahoo Mail user and sent an email to a Gmail account between Aug. 1, 2017 and Sept. 23, 2017, you may have had your email scanned without your consent, and you may be eligible to recover compensation through a Gmail privacy concerns lawsuit.
Lawsuits Over Gmail Privacy Concerns
In September 2015, a consumer filed a Gmail class action lawsuit against Google alleging that the tech giant violated the federal Wiretap Act and the Electronic Communications Privacy Act by scanning emails. The company allegedly intercepted emails to Gmail users in order to create user profiles that could be used for advertising purposes.
In August 2017, a settlement that awarded $2,000 to each lead plaintiff, $2.2 million to class counsel, and $123,500 to the settlement administrator was preliminary approved.
In 2016, Google settled over 875 Gmail privacy concerns damage claims, according to federal court records. In February 2018, an injunction was granted against Google in a class action lawsuit settlement, requiring the company to change their email-scanning policy. As such, the scanning has been stopped and further breaches of privacy may have been prevented.
However, users of Yahoo Mail or another non-Gmail email service may still be eligible to recover compensation for damages related to the scanning. Users who have Gmail privacy concerns may have had their information compromised by Google’s former email scanning policy. Some states, including California, New Hampshire, Massachusetts, and Maryland have specialized privacy laws which may allow users to recover damages through a Gmail privacy concerns lawsuit.
Indeed, some non-Gmail users have already filed lawsuits against the tech giant, aiming to recover damages under these state privacy laws. In March 2018, ten plaintiffs filed a lawsuit in a California Superior Court, alleging that they sustained damages when Google “intercepted, scanned, analyzed and cataloged” their communications even though they were not Gmail users. Plaintiffs in this case aim to recover damages under California’s Invasion of Privacy Act which requires all parties involved in a communication to consent before the communication is intercepted.
Should this Gmail privacy concerns lawsuit end in a favorable verdict for the plaintiffs, Google may owe affected consumers $5,000 in damages per violation — possibly for each interception and scan.
“If each intercepted email constitutes a violation, Google could have billions of dollars in liability,” the plaintiff’s counsel noted in a statement to the press.
If you used a Yahoo Mail or another non-Gmail email account to send an email to a Gmail account while Google was scanning emails, you may be eligible to file a Gmail privacy concerns lawsuit. A Gmail privacy concerns lawsuit could bring claims under the California invasion of Privacy Act or another state’s privacy law, entitling plaintiffs to up to $5,000 in statutory damages for each violation.
