Xfinity debt collection class action lawsuit overview:

  • Who: Plaintiff Travis Pond filed a class action lawsuit against Comcast Cable Communications LLC.
  • Why: Pond claims Comcast violated the Telephone Consumer Protection Act byway of pre-recorded debt collection phone calls sent to consumers from its TV and internet service provider Xfinity.
  • Where: The Xfinity class action lawsuit was filed in Georgia federal court.

A new class action lawsuit alleges that Comcast Cable Communications violates the law by placing pre-recorded phone calls without consent through its Xfinity TV and internet service provider.

Plaintiff Travis Pond’s class action lawsuit claims Xfinity violates the Telephone Consumer Protection Act (TCPA) by placing pre-recorded debt collection calls to consumers through the U.S.

“Unfortunately, Xfinity places pre-recorded debt collection calls to consumers like the Plaintiff who have never done business with Xfinity,” the Xfinity class action says.

Pond wants to represent a nationwide class of consumers who received a pre-recorded phone call from Xfinity within the last four years at a number not connected to an Xfinity account or an authorized representative.

Class action: Xfinity phone calls were intruding

Pond argues the allegedly unauthorized phone calls he received from Xfintiy harmed him in the form of annoyance, nuisance, invasion of privacy, occupied his phone memory, and “disturbed the use and enjoyment of his phone.”

“Despite his requests for the calls to stop, Plaintiff Pond continued receiving unwanted calls from Xfinity,” the Xfinity class action says.

Pond claims he was able to tell the phone calls were pre-recorded, meanwhile, due to the voice sounding robotic, because he heard the same exact message on multiple calls and because he was not given a chance to speak to a human.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual and/or statutory damages for himself and all class members.

Plaintiffs targeted Comcast Xfinity with a trio of class action lawsuits last year over claims revolving around an October 2023 data breach.

The class action lawsuits similarly argued Xfinity failed to properly secure the data of more than 36 million customers during the incident.

The plaintiff is represented by Avi R. Kaufman of Kaufman P.A and Tristan W. Gillespie.

The Xfinity debt collection class action lawsuit is Pond, et al. v. Comcast Cable Communications LLC, Case No. 1:24-cv-03553, in the U.S. District Court for the Northern District of Georgia.

Xfinity has added services to my acct, that they refuse to remove. I have reached out to the third party who Xfinity is saying I am responsible to pay and the third party said I do not even have an account but Xfinity won’t take that for an answer my bill when I signed up was supposed to be 1999 a month for a year it was never 1999 a month it’s always been in the hundreds. They tried to debit over $1,000 out of my account and less than a week’s time thank God I didn’t have that kind of money in there or I would have been really screwed I took off automatic payment and they still were trying to take money out of my account Xfinity seems to do whatever they want to do I’ve had the ACP program helping with my monthly cost if my internet and I’ve also had housing help with my monthly cost of the internet my bill is supposed to be $14.95 both the ACP and my housing have paid $30 a month regarding my Xfinity Internet and my bill is over $200 how is that even possible I have nothing but the internet that’s it no special channels nothing. They have gotten so much money from me and they can’t stop and go over your phone bill with you and explain what the charges are and how a internet bill that’s supposed to be $14.95 a month jumps to 100 every single month. None of their prices are legit not that I’ve ever seen. They can’t show me any documentation of giving permission to change anything on my account all they got is a date and I’ve been fighting with them for the last week they turned off my services because they want me to pay the bill regarding the third party as well but yet they have nothing to do with it they’re telling me but they’re the ones that are charging me not the third party.
