A woman has filed a cancer hair loss lawsuit against the manufacturers of Taxotere (docetaxel), Sanofi Aventis, alleging she suffered permanent and irreversible hair loss as a result of taking Taxotere, a breast cancer treatment medication.
Plaintiff Meredith H. is filing the cancer hair loss lawsuit in Louisiana federal court joining a growing multidistrict litigation (MDL) against the company. The lawsuit was filed on July 5, 2018.
According to the cancer hair loss lawsuit, Meredith is a resident of the state of New York. She says that she took Taxotere between April 27, 2015 and Aug. 7, 2015.
Meredith says that she “experienced significant hair loss after taking Taxotere, and to date her hair has not grown back to the same level and quality as before chemotherapy started.”
The cancer hair loss lawsuit was filed on multiple counts including failure to warn, negligence, negligent misrepresentation, fraudulent misrepresentation, fraudulent concealment, and fraud and deceit.
Meredith demands a trial by jury.
Overview: The Cancer Hair Loss Lawsuit
Sanofi Aventis has faced thousands of lawsuits raising allegations of permanent hair loss side effects that women claim is due to Taxotere. These lawsuits are being filed much like the one filed by Meredith.
Accusations include the allegations that Sanofi should have known or did in fact know about the permanent hair loss side effects that may come about following Taxotere use. The company, however, allegedly failed to disclose that information and properly warn about permanent hair loss side effects that may occur after taking Taxotere.
Taxotere was first approved by the U.S. Food and Drug Administration (FDA) in 1996. It is common for women who undergo chemotherapy to experience hair loss as a normal adverse side effect. What the Taxotere users were completely unaware of, they claim, was that they would suffer permanent hair loss side effects and that their hair would never grow back.
Sanofi is being accused of selling a defective, unsafe and dangerous medication. They are also being accused of negligently designing and manufacturing Taxotere, thereby causing permanent hair loss side effects.
In fact, while warning labels cautioned women of permanent hair loss side effects associated with Taxotere in Europe and Canada, no such warning labels were available to consumers in the U.S. until 2015. This was nearly 20 years after Taxotere’s approval by the FDA.
Eligibility to file a cancer hair loss lawsuit may include patients who were administered Taxotere as part of a chemotherapy treatment plan, those who developed permanent hair loss or permanent alopecia because of Taxotere, were diagnosed for permanent alopecia or permanent hair loss by a medical doctor and can demonstrate that loss.
