Woman Files New Lawsuit Over Late Husband’s Defective Hernia Mesh PatchA Louisiana woman recently added to the growing pile of litigation against Bard, alleging the hernia mesh patch with which her late husband was treated was defective and caused him serious injuries.

According to plaintiff Joyce W., her husband  Benjamin underwent abdominal hernia repair in December 2009, and was implanted with a hernia mesh patch manufactured by Davol, a subsidiary of Bard. Just a few months later, Benjamin allegedly began experiencing extreme abdominal pain, where the device was implanted.

In March 2010, Benjamin suffered from a recurrent hernia, which necessitated surgery to remove the defective hernia mesh patch. At that point, it was found that the device had become detached in multiple areas.

Unfortunately, the problems didn’t end there, Joyce claims. For years, Benjamin allegedly suffered from the after effects of the defective hernia mesh patch—until his death in February 2018.

Joyce alleges in this hernia mesh patch lawsuit that Bard did not adequately warn about the risks associated with the hernia mesh patch. Joyce filed her hernia mesh patch lawsuit on Aug. 23, 2018, in the U.S. District Court for the Eastern District of Louisiana.

The lawsuit was filed on multiple counts, including manufacturing defect, design defect, failure to warn, negligence and several others. Joyce also filed on one count of loss of consortium on her own behalf.

Basics of Bard Hernia Mesh

Patients may be implanted with a Bard hernia mesh patch to reinforce a weak area or patch a hole caused by a hernia. Bard is just one of a number of manufacturers to make hernia mesh, along with Ethicon and others.

Despite the popularity and widespread use of these devices, a growing number of patients implanted with hernia mesh are reporting serious hernia mesh problems. In order to alleviate complications, many are forced to undergo hernia mesh removal.

Hernia Mesh Patch Complications

A number of hernia mesh patch problems have been associated with these devices, including chronic pain, hernia recurrence, mesh rejection, infection, device migration, scarring, inflammation, and tissue and nerve damage.

Device migration can lead to more dangerous problems like infection, adhesion and device failure. For some, symptoms may not appear up to several years after their hernia mesh was implanted. Serious hernia mesh patch problems can require patients to undergo revision surgery.

Of course, any additional surgery will add further risk of infection and other complications, as well as additional medical expenses.
