A North Carolina resident recently filed a DePuy ASR lawsuit against the major medical device manufacturer, alleging that a defective hip implant led to serious complications and necessitated revision surgery.
The plaintiff, Rene R., was implanted with a DePuy ASR hip implant in her right hip in September 2009, but later began experiencing severe side effects. According to her DePuy ASR lawsuit, Rene suffered from pain, device loosening, and a reaction to the metal implant. As a result of these injuries, Rene says she had the device removed in June 2017.
Rene’s injuries were a direct result of a defective hip implant and the manufacturer’s failure to warn her, other patients, and the medical community about the risks associated with the device, alleges the DePuy ASR lawsuit.
Rene filed her DePuy ASR lawsuit on March 30, 2018 in the U.S. District Court for the Northern District of Ohio. The DePuy ASR lawsuit was filed on multiple counts, including negligence, defective design, manufacturing defect, failure to warn, breach of express and implied warranties, fraudulent misrepresentation and concealment, and several others.
Rene is not the first patient to file a DePuy ASR lawsuit over these kinds of complications. Indeed, more and more patients who have been undergone revision surgery due to problems with their DePuy ASR hip implant are filing lawsuits, alleging that the manufacturer failed to adequately warn of the risk. A DePuy ASR hip implant settlement cannot reverse the damage done by side effects of a defective implant, but it can provide some financial compensation to help with medical expenses and lost wages.
Patients have reported a number of major problems after implantation with a DePuy ASR hip implant. Some have reported device failure that requires early replacement. Other complications allegedly include device dislocation, tissue death, metallosis, cancer, and degenerative heart disease. Thousands of lawsuits have been filed over these and other complications.
The U.S. Food and Drug Administration (FDA) issued a recall of the DePuy ASR hip implant device back in August 2010, affecting around 93,000 total hip implant devices across the world. Around a third of these recalled devices were distributed in the U.S.
Filing a DePuy ASR Lawsuit
Lawsuits claim that DePuy failed to adequately warn both the public and the medical community about the risks associated with their device. Had plaintiffs known about the risks linked with the DePuy hip implant device, lawsuits claim, they would have chosen a safer alternative and avoided these complications altogether.
If you or someone you love has suffered from side effects after implantation with a DePuy ASR hip implant device, you may be able to file a DePuy ASR lawsuit. While filing a DePuy ASR lawsuit cannot take away the pain and suffering caused by a defective hip implant, it can help to alleviate the financial burden caused by medical expenses and lost wages.
The DePuy ASR Lawsuit is Case No. 1:18-dp-20024-JJH, in the U.S. District Court for the Western Division of the Northern District of Ohio.
