A New York woman has filed a lawsuit against Bard, alleging she has experienced a number of hernia mesh problems, including chronic abdominal pain and recurrent hernias.
The plaintiff, Evelyn M., says she was diagnosed with a ventral hernia in January 2010, and was implanted with a Bard Composix Kugel hernia mesh product. However, in the years following implantation with the Bard mesh, Evelyn alleges she began experiencing hernia mesh problems.
Evelyn reported suffering from significant scarring and adhesions, chronic abdominal pain, and recurrent hernias from mesh failure. Because of device failure, Evelyn says she had to undergo multiple surgeries.
According to the lawsuit, Evelyn was not given adequate warning about the risk of these hernia mesh problems. The lawsuit was filed on May 16, 2018 in the U.S. District Court for the Eastern District of New York. The hernia mesh problems lawsuit was filed on multiple counts, including negligence, design defect, manufacturing defect, failure to warn, and breach of express and implied warranties, among others.
Evelyn is not the first patient to file a hernia mesh surgery lawsuit over these and other major complications, which can in some cases have long-lasting or permanent effects. If you or someone you love has suffered from side effects of a defective hernia mesh device, you may be able to file a hernia mesh surgery lawsuit.
Basics of Hernia Mesh
Patients may be implanted with hernia mesh to reinforce a weak area or patch a hole caused by a hernia. Bard is just one of a number of manufacturers to make hernia mesh, along with Ethicon and others. Despite the popularity and widespread use of these devices, a growing number of patients implanted with hernia mesh are reporting serious hernia mesh problems. In order to alleviate complications, many are forced to undergo hernia mesh removal.
Hernia Mesh Problems
A number of hernia mesh problems have been associated with these devices, including chronic pain, hernia recurrence, mesh rejection, infection, device migration, scarring, inflammation, and tissue and nerve damage.
Device migration can lead to more dangerous problems like infection, adhesion, and device failure. For some, symptoms may not appear up to several years after their hernia mesh was implanted. Serious hernia mesh problems can require patients to undergo revision surgery. Of course, any additional surgery will add further risk of infection and other complications, as well as additional medical expenses.
Filing a Lawsuit over Hernia Mesh Problems
If you or someone you love has suffered from these or other side effects after undergoing hernia repair, even months or years after the fact, you may be able to file a hernia mesh surgery lawsuit. While filing a lawsuit cannot take away the pain and suffering caused by hernia mesh problems, it can help to alleviate the financial burden caused by medical expenses and lost wages.
The Hernia Mesh Problems Lawsuit is Case No. 1:18-cv-02920, in the U.S. District Court for the Eastern District of New York.
