An Ohio woman recently filed a lawsuit, alleging her Bard hernia mesh device was defective and caused severe complications, including device failure and revision surgery.
The plaintiff, Tanya K., says she underwent umbilical hernia repair in July 2016. A Bard hernia mesh device was used during the repair. Unfortunately, Tanya alleges, the Bard hernia mesh was defective, and failed as a result.
According to her complaint, the device had to be removed in a recurrent hernia repair in October 2017. The doctor noted that he “removed all of the old mesh by performing a transversus abdominis release and dissecting it out of the pelvis.” In fact, alleges the plaintiff, the epigastric vessels had adhered to the mesh, and so had to be tied off to remove the mesh device.
Because of the complications and the resulting revision surgery, Tanya filed a lawsuit against Bard, alleging she was not adequately warned about the risks associated with the Bard hernia mesh with which she was implanted.
According to the lawsuit, even after the revision surgery, Tanya continues to suffer from complications from the defective Bard hernia mesh device.
Tanya filed her Bard hernia mesh lawsuit on July 24, 2018, in the U.S. District Court for the Eastern Division of the Southern District of Ohio. The lawsuit was filed on multiple counts, including manufacturing defect, design defect, failure to warn, negligence, breach of implied warranty, and several others.
Tanya’s husband Chris also filed on one count, alleging the defective Bard hernia mesh led to loss of consortium with his wife.
Basics of Bard Hernia Mesh
The Bard hernia mesh involved in this lawsuit is from the medical device company Davol, which is a subsidiary of parent company Bard. Notably, Bard controls the largest portion of the hernia mesh market.
Patients may be implanted with Bard hernia mesh to reinforce a weak area or patch a hole caused by a hernia. Bard is just one of a number of manufacturers to make hernia mesh, along with Ethicon and others. Despite the popularity and widespread use of these devices, a growing number of patients implanted with hernia mesh are reporting serious hernia mesh problems. In order to alleviate complications, many are forced to undergo hernia mesh removal.
Hernia Mesh Complications
A number of hernia mesh problems have been associated with these devices, including chronic pain, hernia recurrence, mesh rejection, infection, device migration, scarring, inflammation, and tissue and nerve damage.
Device migration can lead to more dangerous problems like infection, adhesion, and device failure. For some, symptoms may not appear up to several years after their hernia mesh was implanted. Serious hernia mesh problems can require patients to undergo revision surgery. Of course, any additional surgery will add further risk of infection and other complications, as well as additional medical expenses.
