According to the Essure birth control injury lawsuit, Rebecca is a resident of the state of Pennsylvania. She says that she was implanted with Essure on April 15, 2005. However, due to being implanted with the birth control system, she allegedly suffered severe and permanent injuries.
The Essure lawsuit was filed on multiple counts including negligence, breach of express warranty, and negligent misrepresentation.
Overview: Essure Birth Control Injury lawsuit
A number of women have filed lawsuits against Bayer Healthcare, the manufacturers of Essure, a permanent contraceptive device. Essure birth control adverse effects described in these lawsuits have ranged from excessive bleeding, pelvic pain, ectopic pregnancy, bloating, rashes and allergic reactions to miscarriage and organ perforation.
Hundreds of plaintiffs have joined together to file Essure lawsuits against the manufacturer. Each of these plaintiffs share similar stories of adverse side effects and complications they suffered and experiences they shared.
Essure is a permanent birth control method that was approved by the U.S. Food and Drug Administration (FDA) in 2002. It became a popular and breakthrough contraceptive device as it offered women an alternative to permanent sterilization thought to only be offered through tubal ligation.
The device was also approved through the FDA’s fast track approval system because if offered the first alternative to surgical sterilization and promised quick recovery. However, there have been several complaints that the device causes severe adverse side effects and complications.
Reported Essure problems have included severe pain, perforation of fallopian tubes, and even death. Allegations also purport that the device, because it was approved through the FDA’s fast track approval system, was approved too soon and that adequate studies were never conducted. Claims say there was insufficient testing to ensure the device’s safety and effectiveness. Plaintiffs also claim that Essure’s approval was also based on questionable studies.
The Essure birth control system is composed of two small metal coils. These coils are placed within a woman’s fallopian tubes. After the coils become inserted tissue grows, surrounding and covering the coils and thereby blocking the tubes. A woman typically returns to her physician once the coils have established to ensure that their tubes are properly blocked and that she is truly sterile.
Many women like Rebecca, however, have claimed that neither their doctors nor they themselves were warned about the adverse side effects associated with Essure. In a similar story, one plaintiff, Kelly M., says that after she became implanted with Essure in 2012 she also suffered from severe pain and discomfort. Some of the adverse effects she suffered included abdominal pain, excessive hair loss, dental problems, chronic fatigue, and excessive weight gain. She claims that before Essure she never experienced any of these complications.
The Essure Birth Control Injury Lawsuit is Case No. 2:18-cv-01157-MSG in the U.S. District Court for the Eastern District of Pennsylvania.
In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
