Woman Files Denali Vena Cava Filter Lawsuit Joining Growing MDLA Denali vena cava filter lawsuit was recently filed by a woman alleging she suffered severe adverse effects and complications after being implanted with a Bard IVC filter device.

Plaintiff Cathryn W. files the Denali vena cava filter lawsuit in Arizona federal court joining a growing multidistrict litigation (MDL) against the company.

According to the Denali vena cava filter lawsuit, Cathryn is a resident of the state of Virginia. She says that she became implanted with the Denali vena cava filter on Nov. 4, 2014. However, due to the implantation, she says that she was diagnosed with a clot in her IVC filter and Caval Thrombosis. Due to complications stemming from the filter, Cathryn claims, she had the IVC filter removed on May 13, 2016.

The Denali vena cava filter lawsuit was filed on multiple counts including manufacturing defect, failure to warn, design defect, negligence, negligent misrepresentation, negligence per se, breach of express warranty, breach of implied warranty, fraudulent misrepresentation, fraudulent concealment, and violations of applicable Virginia law prohibiting consumer fraud and unfair and deceptive trade practices.

Cathryn demands a trial by jury.

Overview: Denali Vena Cava Filter Lawsuit

Cathryn’s Denali vena cava filter lawsuit was filed as part of a large multidistrict litigation, also known as an MDL. An MDL includes all claims filed against a defendant within a common complaint. The Denali vena cava filter lawsuit was filed through a short form master complaint that did not include the number of adverse side effects and complications which Cathryn may have suffered from because of the implantation of the IVC filter.

The Denali vena cava filter, manufactured by C.R. Bard, functions by becoming implanted within the heart’s inferior vena cava that returns deoxygenated blood back to the heart for replenishment. What it does is filter blood clots out of the bloodstream.

The Denali vena cava filter lawsuit reports that the manufacturer knew that their product could lead to severe adverse effects and complications, but failed to warn consumers and public of these occurrences. The manufacturer allegedly continued to market and sell the IVC filter product placing profit and revenue over consumer and patient safety, the lawsuit claims.

Some of the complications that have resulted from a defective IVC filter device includes the lodging of loose fragmented pieces from the IVC filter that may become stuck in a patient’s lungs or heart, migration, filter fracture, device infection, and perforated organs.

The Denali vena cava filter lawsuit says that C.R. Bard should take responsibility for causing the severe damages, side effects, complications, and unexpected death occurrences that patients have suffered from.

The Denali Vena Cava Filter Lawsuit is Case No. 2:18-cv-01422-DGC, in the U.S. District Court for the District of Arizona. The Bard IVC Filter MDL is in re: Bard IVC Filters Products Liability Litigation, MDL No. 2:15-MD-02641-DGC, in the U.S. District Court for the District of Arizona.

If you were implanted with an IVC filter, you may be entitled to compensation–even if you did not suffer complications. Patients who did suffer complications may be able to seek significantly more compensation.

In general, IVC filter lawsuits are filed individually by each plaintiff and are not class actions.
