A woman has filed a Celect IVC Filter lawsuit against the manufacturers of the device, Cook Medical, Inc., alleging she suffered severe adverse side effects and complications.

Plaintiff Stacey T. filed the Celect IVC Filter lawsuit in Indiana federal court joining a growing multidistrict litigation (MDL) against the company. The lawsuit was filed on March 22, 2018.

According to the Celect IVC Filter lawsuit, Stacey is a resident of the state of Maryland. She was implanted with the Cook Celect Vena Cava Filter on Feb. 13, 2015, in Peninsula Regional Medical Center. However, she alleges that because of the device’s implantation, she suffered a range of adverse side effects and complications.

The Celect IVC Filter lawsuit was filed on multiple counts including failure to warn, design defect, negligence, negligence per se, breach of express warranty, breach of implied warranty, Violations of Applicable Maryland Law Prohibiting Consumer Fraud and Unfair and Deceptive Trade Practices, and punitive damages.

Overview: IVC Filter Lawsuit

The Cook Celect Inferior Vena Cava Filter (IVC Filter) is a device that became approved by the U.S. Food and Drug Administration (FDA) in 2008. The device was manufactured and becomes implanted in patients to help prevent blood clots from traveling into the lungs or hearts of patients.

However, there have been serious adverse side effects and complications reported with the Cook Celect IVC filter. This device has been linked to an increased risk of perforation to the heart, lungs, and inferior vena cava of patients. This may lead to other serious side effects and complications that require patients to undergo removal of the IVC filter.

There are many signs of IVC filter complications. Some of these signs may include patients suffering from shortness of breath, nausea, heart rhythm problems, lightheadedness, hypotension, stroke, and severe chest pain.

Studies have recently shown that, in fact, nearly 43% of patients implanted with a Cook Inferior Vena Cava filter have suffered from perforations. Other adverse side effects have also included filter migration and filter fracture throughout the body. These lead to other complications such as strokes, embolisms, and other side effects.

A statement was issued by the FDA in August 2010. They warned of the high risk of device perforation and advised that the longer the device stayed in the body the higher the risk of perforation. They recommended that the devices should generally be removed after 39 days but no later than 54 days.

In a recent study published in the Journal of Vascular Interventional Radiology, the June 2015 study affirmed the high risk of patients suffering from device perforation. Unfortunately, the FDA’s warning and published study came too late for thousands of patients across the country.

Stacey’s Celect IVC Filter Lawsuit is Case No. 1:18-cv-00938-RLY-MJD, in the U.S. District Court for the Southern District of Indiana, Indianapolis Division. The Cook IVC Filter MDL is In re: Cook Medical, Inc. IVC Filters Marketing, Sales Practices and Products Liability Litigation, MDL No. 2570, in the U.S. District Court for the District of Indiana.

If you were implanted with an IVC filter, you may be entitled to compensation–even if you did not suffer complications. Patients who did suffer complications may be able to seek significantly more compensation.

In general, IVC filter lawsuits are filed individually by each plaintiff and are not class actions.
