A Virginia resident recently filed a lawsuit against DePuy, alleging that the company’s ASR hip implant device caused her serious injuries.
The plaintiff, Charlotte B., says she was implanted with a DePuy ASR hip implant device on Aug. 16, 2007, at a Virginia hospital. Unfortunately, in the years following the implantation of this device, Charlotte says she began experiencing a number of complications, such as pain, soreness, and difficulty walking, which grew worse over time. Eventually, in April 2017, these complications necessitated device removal, she claims.
Charlotte has now turned to litigation, alleging that her injuries were the result of a defective ASR hip implant device and DePuy’s failure to warn of these risks—and that, had she been warned, she would have chosen a safer alternative.
Charlotte’s ASR hip implant device lawsuit was filed on Oct. 3, 2018, in the U.S. District Court for the Western Division of the Northern District of Ohio. The lawsuit was filed on multiple counts, including negligence, defective design, failure to warn, negligent infliction of emotional distress, and several others. Charlotte’s spouse, Lynn, also filed on a count of loss of consortium.
ASR Hip Implant Device Litigation
DePuy Orthopaedics (which is a division of pharmaceutical giant Johnson & Johnson) recalled its ASR hip implant device in August 2010, after thousands of patients across the world had been implanted with it. Indeed, the recall included around 93,000 total hip implant devices, around a third of which were distributed in the U.S.
Charlotte’s lawsuit joins the growing pile of litigation filed against DePuy over ASR hip implant device defects, including device failure and metallosis. This is part of a group of lawsuits that have been brought together into multidistrict litigation, or MDL, which is meant to speed up the litigation process.
Plaintiffs allege that their defective ASR hip implant device caused serious complications or device failure, often leading to revision surgery. Lawsuits allege that DePuy failed to adequately warn about the problems associated with its ASR hip implant device, placing patients at risk.
Filing an ASR Hip Implant Device Lawsuit
Lawsuits allege that DePuy failed to warn the medical community and patients like Charlotte about the risks they knew to be associated with their ASR hip implant device, including side effects like device failure and metallosis. If patients had been given this warning, they would have chosen a safer alternative and avoided these risks in the first place.
