Williams-Sonoma class action alleges retailer falsely advertises free shipping

Williams-Sonoma class action lawsuit overview:

Williams-Sonoma misleads consumers by falsely advertising free shipping for items purchased on the website for its Rejuvenation lighting, hardware and home furnishings brand, a new class action lawsuit alleges. 

Plaintiff Dimitri Kermani’s class action lawsuit claims Williams-Sonoma never intends to make good on its promises of “Free Shipping” for items purchased on Rejuvenation’s website.

“Defendants’ conduct demonstrates a deliberate scheme to mislead consumers into making purchases based on promises of ‘Free Shipping’ that they did not intend to honor,” the Williams-Sonoma free shipping class action argues. 

Kermani wants to represent a California class of consumers who, within the last four years,  purchased a product from Rejuvenation’s website that was represented as “Free Shipping Site-Wide,” and who were subsequently charged for shipping. 

Williams-Sonoma free shipping offer had undisclosed restrictions, class action claims

Kermani argues he was charged a shipping fee of $159 for an item he bought on Rejuvenation’s website, despite it appearing to be part of a “Free Shipping Site-Wide” promotion. 

The class action lawsuit claims Kermani was told by a customer service representative prior to making the purchase that he would be refunded the shipping fee, however Kermani argues he was later informed his item had not actually been eligible for free shipping due to its weight. 

Kermani claims this apparent restriction “was not disclosed on the product page or any easily accessible section of the website.” 

“Plaintiff has time-stamped photos, screenshots, and video evidence showing that Defendants misrepresented the availability of free shipping and that the exclusion information provided was insufficient, vague, and misleading,” the Williams-Sonoma class action says. 

Kermani claims Williams-Sonoma and Rejuvenation are guilty of fraud and violating California’s False Advertising Law. He demands a jury trial and requests declaratory and injunctive relief and an award of compensatory damages in the form of actual, statutory and punitive damages for himself and all class members. 

A consumer filed a separate class action lawsuit against Williams-Sonoma last year over allegations the company failed to pay proper overtime to its non-exempt workers during a Kronos service caused by a December 2021 ransomware attack.
