Whole Foods cheese crackers class action lawsuit overview:

A new class action lawsuit alleges Whole Foods misrepresents its 365 brand Organic Mini Sandwich Cheese Crackers as being made with real organic cheddar cheese.

Plaintiff Edward Lovera’s class action lawsuit claims the Whole Foods cheese crackers contain more palm oil than cheese, despite being advertised as being made with real organic cheddar cheese.

“Instead of the nutritive value, such as protein, good fats, vitamins and minerals, provided to cheese from its most important component, milkfat, palm oil lacks such nutrients,” the Whole Foods cheese crackers class action says. 

Lovera wants to represent a New York class of consumers who purchased Whole Foods cheese crackers during the statute of limitations period for each cause of action.

False representations allowed higher prices for Whole Foods cheese crackers, class action claims

Lovera argues he would not have paid as much for the Whole Foods cheese crackers had he been aware that real organic cheddar cheese was not the product’s exclusive or predominant filling ingredient.

“As a result of the false and misleading representations and omissions, the Product is sold at a premium price,” the Whole Foods cheese crackers class action says. 

Lovera claims Whole Foods is violating New York General Business Law. He demands a jury trial and requests declaratory and injunctive relief and an award of monetary damages for himself and all class members.

A consumer filed a similar class action lawsuit against Mondelez Global LLC last year over claims the company misrepresented its Ritz Bits Cracker Sandwiches as being made with real cheese when their primary filling ingredient was not cheese. In another similar class action from earlier this year, a consumer claimed Eagle Family Food Groups LLC falsely advertised that its Hamburger Helper and Tuna Helper products are made with real cheese.
