Walmart class action lawsuit overview:

  • Who: Plaintiff Quina Myers filed a class action lawsuit against Walmart Stores Inc.
  • Why: Myers claims that Walmart charges consumers more than the price listed on Rollback stickers, price stickers and yellow stickers causing them to overpay for the items.
  • Where: The Walmart class action lawsuit was filed in Arkansas federal court.

A new Walmart class action lawsuit alleges the retail giant overcharges consumers for food, baby products, appliances and other products.

Plaintiff Quina Myers claims Walmart charged incorrect prices for items tagged in the aisles between Feb. 1 and July 29, 2024.

Myers says she shopped for food and baby products at Walmart during this timeframe. When she reviewed her receipts, she says she noticed the price she was charged did not match the price quoted on the product.

She says she selected the items with the expectation she would be charged the amount on the price sticker. However, when she checked out, โ€œWalmartโ€™s [point of sale] system deceptively, programmatically and artificially increased the prices of the products,โ€ the Walmart class action lawsuit says.

The Walmart class action lawsuit notes the retail giant accounted for more than a quarter of all grocery revenues in the United States, accumulating $648 billion in sales in 2024.

Myers claims Walmart gained its market power by squeezing out smaller grocery stores and other retailers with its low prices and consolidated shopping experiences.

Walmart class action says consumers charged prices that do not match sticker price

The Rollback stickers, price stickers and yellow stickers printed on items are important to consumersโ€™ purchasing decisions and entice them to purchase the products at the listed prices, the Walmart class action lawsuit alleges.

Consumers reasonably expect they will be charged for the amount listed on the Rollback stickers, price stickers and yellow stickers, Myers claims. She claims consumers were charged amounts that exceeded the lowest advertised prices on the price stickers, causing them to suffer actual damage by overpaying for the products.

Myers filed the Walmart class action lawsuit on behalf of herself and a proposed nationwide class of consumers who purchased Roll Back or Price Sticker products from a Walmart store in the United States during the class period. She also seeks to represent a Pennsylvania subclass.

The Walmart class action lawsuit asserts claims for violations of Pennsylvaniaโ€™s Unfair Trade Practices and Consumer Protection Law, declaratory judgment and unjust enrichment.

Walmart employees recently won a โ€˜substantialโ€™ settlement over required pre-shift COVID-19 screenings.

I recently noticed on dish soap that the price was marked on clearance. Then a couple weeks later, the same item was then marked normal price yet cheaper than the clearance price just a few weeks before.
This is factual because I purchased said item.

  3. Kathryn M Green says:

I have also been over charged for various items. I noticed it the most with various household and laundry items. It had gotten so bad, I had to start taking pictures of the rollback prices on everything. Then the self checkout clerks thought I was lying, and sometimes the price was not adjusted. The person checking the price would pull the tag and say there was no rollback on the item. This mainly happened at the Walmart on Mt Highway in Spanaway, Washington.

  4. Faith A Rock says:

I too have found this problem of different items placed in different isles and priced differently. Why do they do this? They are going to lose customers as I have gone to Target to shop because I donโ€™t find this price changing there

  5. Tamsen Michaud says:

Walmart is famous for listing one price and ringing it up at a higher price. They like to put items in two or three different aisles with different prices. I have learned where and on which aisle the cheapest-priced item is located. Walmart is going downhill, in my opinion, right along with customer service.

  6. Larry Burns says:

I,ve been over charged many times. I called Arkansas still nothing done the price on the show isnโ€™t always the price at the register.

  7. Cindy Borgstahl says:

Iโ€™ve also noticed incorrect, higher charges at Walmart. Iโ€™ve also seen different prices for the same product in two different aisles.

I have taken pictures of items that were reduced in price in order to avoid incorrect charges, i use self checkout, and show the pic to cashier which adjust the price or calls manager that goes and checks the amount . Walmart has to be kept in place, please add me to suit. Another issue is buying items online that are though โ€œWalmart Marketplace โ€œ as iโ€™ve had an order cancelled due to them not suggesting substituting another item instead which is what their terms say they can do, waited over 30 days to find out though that pricing was incorrect from seller on Walmartโ€™s site.
