A new Walmart class action lawsuit alleges the retail giant overcharges consumers for food, baby products, appliances and other products.

Plaintiff Quina Myers claims Walmart charged incorrect prices for items tagged in the aisles between Feb. 1 and July 29, 2024.

Myers says she shopped for food and baby products at Walmart during this timeframe. When she reviewed her receipts, she says she noticed the price she was charged did not match the price quoted on the product.

She says she selected the items with the expectation she would be charged the amount on the price sticker. However, when she checked out, โ€œWalmartโ€™s [point of sale] system deceptively, programmatically and artificially increased the prices of the products,โ€ the Walmart class action lawsuit says.

The Walmart class action lawsuit notes the retail giant accounted for more than a quarter of all grocery revenues in the United States, accumulating $648 billion in sales in 2024.

Myers claims Walmart gained its market power by squeezing out smaller grocery stores and other retailers with its low prices and consolidated shopping experiences.

Walmart class action says consumers charged prices that do not match sticker price

The Rollback stickers, price stickers and yellow stickers printed on items are important to consumersโ€™ purchasing decisions and entice them to purchase the products at the listed prices, the Walmart class action lawsuit alleges.

Consumers reasonably expect they will be charged for the amount listed on the Rollback stickers, price stickers and yellow stickers, Myers claims. She claims consumers were charged amounts that exceeded the lowest advertised prices on the price stickers, causing them to suffer actual damage by overpaying for the products.

Myers filed the Walmart class action lawsuit on behalf of herself and a proposed nationwide class of consumers who purchased Roll Back or Price Sticker products from a Walmart store in the United States during the class period. She also seeks to represent a Pennsylvania subclass.

The Walmart class action lawsuit asserts claims for violations of Pennsylvaniaโ€™s Unfair Trade Practices and Consumer Protection Law, declaratory judgment and unjust enrichment.

Walmart employees recently won a โ€˜substantialโ€™ settlement over required pre-shift COVID-19 screenings.

    This happens frequently, even now. Usually, we can catch it at the register. Sometimes, itโ€™s not until you drive back to town. If itโ€™s just a dollar or so, I usually donโ€™t do anything. Sometimes, itโ€™s a few dollars or several items that are maybe 85 cents too much each. Then, on the next trip I tell them. If itโ€™s several dollars, I usually call the store and get the personโ€™s name to write on the receipt. The reason for that, is because the price may not be the same next time or it may have been a close out item and they act like youโ€™re a liar. By the same token, Iโ€™ve gotten to the register and an item is CHEAPER than the sticker or shelf price was. That happens sometimes with closeout items. But, again it means theyโ€™re not keeping up on their marking system. It feels a lot better to see something a little cheaper, then it does being charged too much. Unfortunately, 90% of the time, itโ€™s overpricing.

    This is very true, I was buying a rug shampooer and sticker price said 1 thing, when I got to the register to check out it was alot higher, told me they didnโ€™t take the sales sticker down.

    This is true. I noticed this some years back. I have purchased wet cat food and noticed that I am charged a higher price at the register than what is priced on the shelf. I believe that Walmart relies on customers not making a big deal about it just to keep others in line from getting upset for the delay at checkout.
