Walmart class action lawsuit overview:

  • Who: Plaintiff Brigette Hood filed a class action lawsuit against Walmart Inc.
  • Why: Hood claims that Walmart falsely advertises its aluminum products as being made in the United States.

A Walmart class action lawsuit alleges the retailer falsely advertises its aluminum products as “Made in the USA” even though the products are not completely processed domestically or made of materials sourced in the United States.

Plaintiff Brigette Hood says the Walmart aluminum “Made in the USA” label leads consumers to expect the product to originate in the U.S.

“But that is not the case–the products have significant foreign input in the form of bauxite, the primary ingredient in aluminum,” the Walmart class action lawsuit explains, noting almost no bauxite is mined in the U.S.

“The overwhelming majority of the material is mined and significantly processed internationally, then imported from overseas and used to create the products,” Hood claims.

Walmart aluminum ‘Made in USA’ label is unlawful, plaintiff says

The U.S. Federal Trade Commission has provided guidance about the use of “Made in the USA” claims. The FTC says it is an unfair or deceptive practice to use a “Made in the USA” label unless the final assembly or processing occurs in the U.S., all significant processing takes place in the United States and nearly all components are made and sourced in the United States.

Hood claims Walmart knows many consumers desire U.S.-made products and will pay a premium for products they believe are made in the country. She says Walmart aluminum products are labeled as “Made in the USA” to give them a competitive edge in the market.

When she purchased Walmart aluminum products, Hood says she did not know the “Made in USA” claim was unlawful and misleading. She says she paid more for the products than she would have if she had known the materials were sourced overseas.

The Walmart class action lawsuit asserts claims for violations of the California Consumers Legal Remedies Act, Unfair Competition Law, False Advertising Law, breach of express and implied warranties and unjust enrichment

Reynolds Consumer Products LLC faces a similar class action lawsuit over its allegedly false “Made in the USA” claims.
