Update:ย

  • The 7th Circuit reversed a district courtโ€™s decision to toss a class action lawsuit filed against Walmart over claims it used false and misleading shelf pricing.ย
  • The appeals court disagreed with the theory that providing customers with a receipt with the actual price was sufficient to dispel any potential deception or unfairness caused by an inaccurate shelf price.ย
  • The court did agree with Walmart that the complaint did not allege a plausible likelihood of future injury needed for injunctive relief under the Illinois Uniform Deceptive Trade Practices Act.ย
  • The plaintiff claims Walmart customers paid around 5-10% more than they expected due to allegedly false and misleading shelf price advertising.ย

See Walmart and Target place false and misleading advertisements on price displays and shelf signs, a pair of new class action lawsuits allege.

Plaintiff Yoram Kahn claims in separate class action lawsuits that Walmart and Target use what is known as shelf pricing that โ€œfrequently misrepresents the prices consumers are charged at the point of sale.โ€ย

Kahn argues Walmart and Targetโ€™s alleged price misrepresentations cause consumers to โ€œfall victim to a classic โ€˜bait and switch,โ€™โ€ and โ€œunknowingly overpayโ€ Walmart and Target โ€œa higher price for the falsely-advertised merchandise at checkout.โ€ย

โ€œConsumers reasonably rely on Shelf Pricing to make informed purchasing decisions, and reasonably expect to pay the advertised Shelf Price when they reach the checkout,โ€ states the Walmart class action and Target class action.ย

Kahn wants to represent a nationwide Class and Illinois subclass of consumers who have purchased merchandise from Walmart and/or Target and who paid a higher price than what was the advertised shelf price.ย

Merchandise affected by allegedly false and misleading shelf price advertising end up costing consumers around 5-10% more at Walmart and around 5-20% more at Target, the Walmart class action and Target class action allege.ย

Walmart and Target are aware they are โ€˜deceivingโ€™ consumersย

Kahn argues that consumers can also be overcharged โ€œmuch higherโ€ and that Walmart and Target are both aware that they are โ€œdeceiving its consumers.โ€ย

Further, Khan claims that, while Target and Walmart have been fined for their alleged practice of misrepresenting shelf prices, the punishment does not dissuade them since the amount of profit they make each year from the practice exceeds the amount they pay in fines.ย

Walmart and Target, thus, simply โ€œpays the fines but continues its misleading, unfair and deceptive pricing practices,โ€ according to the Walmart class action and Target class action.ย

Kahn claims Walmart and Target are guilty of unjust enrichment and in violation of the Illinois Consumer Fraud and Deceptive Practices Act and the Illinois Uniform Deceptive Trade Practices Act, among other things.ย

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, compensatory, and punitive damages for himself and all Class Members.ย

A separate class action lawsuit was filed against Target earlier this month by a consumer claiming it falsely markets its hydrogen peroxide solution as being an effective treatment for minor cuts.ย

The plaintiff is represented by Scott H. Gingold of Gingold Legal, and Stanley D. Bernstein, Sandy A. Liebhard, Stephanie M. Beige, Jeffrey McEachern, and Hairong Basil of Bernstein Liebhard LLP.ย

The Target, Walmart Shelf Pricing Class Action Lawsuits are Kahn v. Walmart, Inc., Case No. 1:22-cv-04177, and Kahn v. Target Corporation, Case No. 1:22-cv-04178, in the U.S. District Court for the Northern District of Illinois.

They have priced items, 10 pairs of sox, $5.99, but either they have repackaged the item or the product cause now the only product is 8 pairs for the same or more than the $5.99. When I spoke with the manger she couldnโ€™t understand what the problem was and tried to tell me itโ€™s the new packaging but at the same price. I pointed out the discrepancy between what the tag on the shelf said and the only difference was fewer pairs of sox being sold for what the shelf tag said would be 10 pairs and the packaging held only 8 pairs and everything was good. I tried to explain if she was buying a dozen eggs but the carton only contained 10 eggs would she not be getting ripped off she couldnโ€™t bring herself to admit to the deception and continued to I sister that the difference was a normal thing and I would not get a discount. She couldnโ€™t understand what the problem was and wouldnโ€™t admit that she herself wouldnโ€™t feel like she was being deceived in by what the shelf said and what was being sold.

This happens to me more often than not when I shop at either of these stores. Itโ€™s super frustrating and an inconvenience to say the least.

I have paid hundreds for grocery food and clothing items, I hope that what they say is the same PRICE that they tell me but I have had to go back and ask them WHY they charged me a different price or a higher one and they just say โ€œOh someone must have moved that item to another shelf or hung it up in a different area and then I have to REFUSE it becasue its NOT the price that it said originally! Please put me on the list.

I continually find that Walmart will advertise a shelf price, but it rings up incorrectly. So often, that I take photos of the shelf sale price so I have it when I get to the register. The checkers (I refuse to use self check out) tell me that this happens all the time. I would like to join that lawsuit.

This has definitely happened to me more than a few times at Walmart and Target!
