Update:ย

  • The 7th Circuit reversed a district courtโ€™s decision to toss a class action lawsuit filed against Walmart over claims it used false and misleading shelf pricing.ย
  • The appeals court disagreed with the theory that providing customers with a receipt with the actual price was sufficient to dispel any potential deception or unfairness caused by an inaccurate shelf price.ย
  • The court did agree with Walmart that the complaint did not allege a plausible likelihood of future injury needed for injunctive relief under the Illinois Uniform Deceptive Trade Practices Act.ย
  • The plaintiff claims Walmart customers paid around 5-10% more than they expected due to allegedly false and misleading shelf price advertising.ย

See Walmart and Target place false and misleading advertisements on price displays and shelf signs, a pair of new class action lawsuits allege.

Plaintiff Yoram Kahn claims in separate class action lawsuits that Walmart and Target use what is known as shelf pricing that โ€œfrequently misrepresents the prices consumers are charged at the point of sale.โ€ย

Kahn argues Walmart and Targetโ€™s alleged price misrepresentations cause consumers to โ€œfall victim to a classic โ€˜bait and switch,โ€™โ€ and โ€œunknowingly overpayโ€ Walmart and Target โ€œa higher price for the falsely-advertised merchandise at checkout.โ€ย

โ€œConsumers reasonably rely on Shelf Pricing to make informed purchasing decisions, and reasonably expect to pay the advertised Shelf Price when they reach the checkout,โ€ states the Walmart class action and Target class action.ย

Kahn wants to represent a nationwide Class and Illinois subclass of consumers who have purchased merchandise from Walmart and/or Target and who paid a higher price than what was the advertised shelf price.ย

Merchandise affected by allegedly false and misleading shelf price advertising end up costing consumers around 5-10% more at Walmart and around 5-20% more at Target, the Walmart class action and Target class action allege.ย

Walmart and Target are aware they are โ€˜deceivingโ€™ consumersย

Kahn argues that consumers can also be overcharged โ€œmuch higherโ€ and that Walmart and Target are both aware that they are โ€œdeceiving its consumers.โ€ย

Further, Khan claims that, while Target and Walmart have been fined for their alleged practice of misrepresenting shelf prices, the punishment does not dissuade them since the amount of profit they make each year from the practice exceeds the amount they pay in fines.ย

Walmart and Target, thus, simply โ€œpays the fines but continues its misleading, unfair and deceptive pricing practices,โ€ according to the Walmart class action and Target class action.ย

Kahn claims Walmart and Target are guilty of unjust enrichment and in violation of the Illinois Consumer Fraud and Deceptive Practices Act and the Illinois Uniform Deceptive Trade Practices Act, among other things.ย

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, compensatory, and punitive damages for himself and all Class Members.ย

A separate class action lawsuit was filed against Target earlier this month by a consumer claiming it falsely markets its hydrogen peroxide solution as being an effective treatment for minor cuts.ย

The plaintiff is represented by Scott H. Gingold of Gingold Legal, and Stanley D. Bernstein, Sandy A. Liebhard, Stephanie M. Beige, Jeffrey McEachern, and Hairong Basil of Bernstein Liebhard LLP.ย

The Target, Walmart Shelf Pricing Class Action Lawsuits are Kahn v. Walmart, Inc., Case No. 1:22-cv-04177, and Kahn v. Target Corporation, Case No. 1:22-cv-04178, in the U.S. District Court for the Northern District of Illinois.

  1. CAROL MCFARLAND says:

no matter which WALMART I shop in ILLINOIS< I have had items rung up incorrectly and customer services are not any help.

  2. Natalie Foreman says:

That happens often, especially on clearance items, when I go shopping in the local Walmart stores in Alabama. Unfortunately, I donโ€™t notice the higher price difference until Iโ€™m home, which is 20 minutes from the Walmart.

  3. Sharee says:

Well Iโ€™ve had caught prices a few many times shopping for my family even when working there and said something. It does happen. If its happening to one or two how many more people that shop there every that worry about feeding there family have to deal with that when a bag is 50 or 60 $ now days people are starving and people keep raising prices to get more money from us we are all here trying to survive and people that own big companies only care about numbers and not people that are suffering and they have everything. It sucks. I wish the world would help each other not hurt that will be the only way we all can try to make it by having concern for people not money that means nothing its just paper your weathly in your heart thatโ€™s the real riches not paper money. I hope everyone starts help each other not hurting each other and greed. People make bad choices yes but maybe if people took time to understand others it would help.

  4. Bruce Lipkin says:

This has been going on at Walmart for years. I stopped complaining as almost everything in my cart is priced โ€œwrong.โ€ Of course, WM employees do not care (wonder if theyโ€™re instructed to ignore customer pricing complaints?).

  5. Rita Mills says:

YES! This also happened in Leominster, Ma & Lunenberg, Ma on multiple occasions. By the time Iโ€™m checked out with a full cart of groceries and get home to review the receipt, I only went back 1 time out of the many and they fought me in the price difference telling me that โ€œit must have been being changed in the system after I took it from the shelfโ€ deceptive and lies.

  8. Elaine Moreau says:

Yes, Iโ€™ve had to wait in line at customer service when I caught a price โ€œmistakeโ€ then wait while they send someone to confirm the shelf price.
Very annoying, and who knows how many times I have missed it? Pleases add me.

    1. Veronica Dye says:

YES, I BELIEVE THAT FORNIT HAD HAPPEN TO MORE TIMES I CAN REMEMBER. Iโ€™VE ALSO BEEN DOUBLE (CHARGE) FOR AN ITEM AT LEAST (2 TO 3) TIMESNIN THE PAST. I LET IT GO AND DIDNโ€™T DISPUTE IT BECAUSE OF WORK SCHEDULE. THANK YOU

  9. Rosetta Johnson says:
