Update:ย 

  • The 7th Circuit reversed a district courtโ€™s decision to toss a class action lawsuit filed against Walmart over claims it used false and misleading shelf pricing.ย 
  • The appeals court disagreed with the theory that providing customers with a receipt with the actual price was sufficient to dispel any potential deception or unfairness caused by an inaccurate shelf price.ย 
  • The court did agree with Walmart that the complaint did not allege a plausible likelihood of future injury needed for injunctive relief under the Illinois Uniform Deceptive Trade Practices Act.ย 
  • The plaintiff claims Walmart customers paid around 5-10% more than they expected due to allegedly false and misleading shelf price advertising.ย 

Target, Walmart shelf pricing class action lawsuits overview:ย 

  • Who: Yoram Kahn filed separate class action lawsuits against Walmart, Inc. and Target Corporation.ย 
  • Why: Khan claims Walmart and Target use false and misleading shelf pricing which misrepresents the amount a consumer will actually have to pay for the merchandise at checkout.ย

See Walmart and Target place false and misleading advertisements on price displays and shelf signs, a pair of new class action lawsuits allege.

Plaintiff Yoram Kahn claims in separate class action lawsuits that Walmart and Target use what is known as shelf pricing that โ€œfrequently misrepresents the prices consumers are charged at the point of sale.โ€ย 

Kahn argues Walmart and Targetโ€™s alleged price misrepresentations cause consumers to โ€œfall victim to a classic โ€˜bait and switch,โ€™โ€ and โ€œunknowingly overpayโ€ Walmart and Target โ€œa higher price for the falsely-advertised merchandise at checkout.โ€ย 

โ€œConsumers reasonably rely on Shelf Pricing to make informed purchasing decisions, and reasonably expect to pay the advertised Shelf Price when they reach the checkout,โ€ states the Walmart class action and Target class action.ย 

Kahn wants to represent a nationwide Class and Illinois subclass of consumers who have purchased merchandise from Walmart and/or Target and who paid a higher price than what was the advertised shelf price.ย 

Merchandise affected by allegedly false and misleading shelf price advertising end up costing consumers around 5-10% more at Walmart and around 5-20% more at Target, the Walmart class action and Target class action allege.ย 

Walmart and Target are aware they are โ€˜deceivingโ€™ consumersย 

Kahn argues that consumers can also be overcharged โ€œmuch higherโ€ and that Walmart and Target are both aware that they are โ€œdeceiving its consumers.โ€ย 

Further, Khan claims that, while Target and Walmart have been fined for their alleged practice of misrepresenting shelf prices, the punishment does not dissuade them since the amount of profit they make each year from the practice exceeds the amount they pay in fines.ย 

Walmart and Target, thus, simply โ€œpays the fines but continues its misleading, unfair and deceptive pricing practices,โ€ according to the Walmart class action and Target class action.ย 

Kahn claims Walmart and Target are guilty of unjust enrichment and in violation of the Illinois Consumer Fraud and Deceptive Practices Act and the Illinois Uniform Deceptive Trade Practices Act, among other things.ย 

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, compensatory, and punitive damages for himself and all Class Members.ย 

A separate class action lawsuit was filed against Target earlier this month by a consumer claiming it falsely markets its hydrogen peroxide solution as being an effective treatment for minor cuts.ย

    walmart is the closest stores to where i live but they are over charging . the price at the shelf is not the price when its scanned and when i bring it with the picture i took they always say thay they are in the middle of fixing the shelf but never do

    Rollback price was 24.97, was charged 49.97 in /Colgate Teeth Whitener with a red light in box. Duck Jerky for dogs, etc.

      I was not aware of this lawsuit until now, but I have been documenting the same overcharging issues at Walmart for the last 8 months. I have receipts and photos to document my claims, and have made several attempts to bring this to Walmarts attention. They promise a response within 3 business days, but never follow through. I would love to know how to pursue this issue. We have been shopping at Walmart for 40 years. No telling how much we have overpaid.

    It happens ALOT here I Orangeburg south รงarolina walmart and target arenโ€™t the only 2 stores someone needs to look into dollar general as well I shop at dollar general and walmart more and I noticed so many times the prices were off sometimes by anywhere from..50 to 2.00. And they didnโ€™t care sometimes you can get them to walk to.where the item is and show them and they make some lame excuse up like someone put the wrong price or something but it shouldnโ€™t matter thatโ€™s the price I was expecting to buy this item not what you are charging but what can we do not buy anything. Thank you for doing this Iโ€™m tired of being ripped off regularly.

    Actually, I just arrived home after researching walmarts website for a SD card priced at $12.99 online. Came home to find THE security case still on it & my receipt says $19.99. I used my app price scanner on the item & it came up as costing $12.99. So why did the register charge me $19.99. If they wouldnโ€™t have left the security case still on my item, I never would have even looked at my receipt. I go to walmart multiple times a week, no telling how much this company has stolen from me! Why do corporations get away with fraud & theft but Walmart is quick to lineback tackle someone & press charges for stealing a .99 eyeliner! My God at least pay your employeeโ€™s a livable wage with all the money you are fraudulently charging & stealing from your customers. I guess annual gross profit of $147.568B, a 2.65% increase from 2022 wasnโ€™t enough. I have screen shots, the item and my receipt. Iโ€™m ready to JOIN!

    This happens all of the time. I went into Walmart a tot was on clearance for $2 they were charging $8 for it. I questioned it they argued but I got it for the price on the shelf. Itโ€™s always been this way their excuse always is someone put it in the wrong place.

    I have always watch what the register says to what the shelf says ever since early 2022 if itโ€™s not right I try to find someone to fix but thatโ€™s not easy being they got rid of real people to check you out instead you check yourself out

    At a recent trip to the Target in my home town in Northern Virginia, I purchased an Origins brand face skincare product. It was located in the high-end cosmetics section that was recently added to the store. There was no price shown for the product but as I was walking to the self-checkout register, I noticed an additional display with Origins products that contained the same product I had grabbed but in a much larger bottle (about twice the size). The price marked for the large size was $40. When I got to the register and scanned my much smaller bottle, the register said it was also $40! โ€ฆThe same price as the larger bottle. When I asked the employee about it, she seemed annoyed. It took her a while to realize that I was about to pay $40 for something I could get twice as much of for the SAME price. Iโ€™m going to be very vigilant when I shop at Targetโ€ฆby checking the price in the store (on the tag or the pricing kiosk) and on the register or receipt when I check out.

    Yes they do it!! Theyโ€™ve done it to me and itโ€™s on my IG page. The sticker on the item said it was $3.48 but when Iโ€™d scanned it at self checkout it scanned at $4.98 ($1.50 more). Iโ€™d recorded it and showed the employee she sheโ€™d changed it but I have it on camera. Contact me for the video.

    Iโ€™ve noticed it here for a couple of months that we have been getting overcharged that it says one thing on the shelf and then when you check out itโ€™s a more expensive price here in cottonwood Arizona at the Walmart and rimrock Arizona at the Dollar general.

    Itโ€™s happening here in Chattanooga tn also I first realized it when I scanned the item on my walmart app then later looked at my checkout receipt and everything rung up higher than the maker shelf prices. I angry for letting stores do that to customers.. itโ€™s hard enough to survive the already marked up prices then to get more put on us at the checkout Iโ€™m going to stop shopping at these locations and my family and friends too.
