A new class action lawsuit alleges Vitas Hospice Services failed to protect sensitive patient and employee data in a recent data breach.

Plaintiff Darlene Miakos filed the class action complaint against Vitas Hospice Services, L.L.C. on Nov. 24 in a Florida federal court, alleging violations of state and federal data privacy laws.

Vitas provides hospice care and other health care services nationwide, storing highly sensitive personal identifiable information (PII) and protected health information (PHI) about its current and former patients and employees, the lawsuit says.

However, Miakos alleges that Vitas lost control over that data when cybercriminals infiltrated its computer systems in a hospice data breach.

According to the lawsuit, the breach occurred between Sept. 21 and Oct. 27, 2025, but Vitas only discovered it on Oct. 24, 2025.

Miakos claims that Vitas failed to adequately train its employees on cybersecurity and failed to maintain reasonable security safeguards or protocols to protect the data, leaving it vulnerable to cybercriminals.

Vitas failed to notify about data breach in a timely manner, lawsuit says

The lawsuit alleges that Vitas’s failures placed the private information of its patients and employees in a vulnerable position, rendering them easy targets for cybercriminals.

The hospice breach exposed the private information of Miakos and other class members to cybercriminals, causing numerous injuries and significant damages, the lawsuit says.

Miakos claims that Vitas failed to notify the affected individuals promptly, depriving them of the opportunity to try to mitigate their injuries in a timely manner.

The class action lawsuit seeks to represent anyone in the United States whose private information was compromised in the Vitas Hospice Services class action data breach discovered by Vitas in October 2025.

It alleges violations of state and federal data privacy laws, negligence, breach of implied contract, invasion of privacy, unjust enrichment, and breach of fiduciary duty.

Miakos is seeking certification of the class action, damages, restitution, and injunctive relief.

Recently, a Connecticut judge gave preliminary approval to a $18M class action settlement between Yale New Haven Health Services Corp. and individuals affected by a March 2025 data breach.
