A new class action lawsuit accuses Victoria’s Secret of failing to properly safeguard the personally identifiable information (PII) of its customers.
Plaintiff Susan Wardle-Burke’s class action lawsuit claims the retailer failed to implement industry-standard security measures to prevent a data breach that occurred on or about May 27, 2025.
Wardle-Burke wants to represent a nationwide class of consumers whose PII was allegedly exposed in the Victoria’s Secret data breach.
The plaintiff claimed that the data breach was “a direct result of Defendant’s failure to implement adequate and reasonable cybersecurity procedures and protocols necessary to protect individuals’ PII with which it was entrusted for either treatment or employment, or both.”
Victoria’s Secret failed to comply with industry standards, class action alleges
Wardle-Burke claims Victoria’s Secret failed to comply with industry standards by not encrypting sensitive data, not conducting regular security audits and not providing adequate training to employees on data security.
“As a result of the data breach, the plaintiff and the other class members must now be vigilant and review their credit reports for suspected incidents of identity theft and educate themselves about security freezes, fraud alerts and other steps to protect themselves against identity theft,” the lawsuit says.
Wardle-Burke claims Victoria’s Secret violated federal and state laws, including the Federal Trade Commission Act, which prohibits unfair and deceptive practices, and state consumer protection statutes.
Wardle-Burke demands a jury trial and requests damages, restitution and injunctive relief on behalf of a nationwide class of consumers whose PII was exposed in the Victoria’s Secret data breach.
In March, Victoria’s Secret agreed to a class action settlement resolving claims that it charged Missouri customers too much sales tax on out-of-state purchases.
