
Via Credit Union data breach class action lawsuit overview:

A new nationwide class action lawsuit alleges Via Credit Union failed to adequately protect the personal information of more than 60,000 of its customers during a data breach earlier this year.
Plaintiff William Runyan claims Via Credit Union failed to implement adequate and reasonable cybersecurity measures to protect the personally identifiable information (PII) of its customers during a January 2025 data breach.
The Via Credit Union class action alleges Via Credit Union maintained the private information of its customers in “a reckless manner” and in “a condition vulnerable to cyberattacks” which was a known risk.
Runyan wants to represent a nationwide class of all persons whose private information was compromised due to the Via Credit Union data breach that cyber experts determined occurred between Jan. 18, 2025, and Jan. 20, 2025.
Class action claims Via Credit Union failed to properly monitor data
The Via Credit Union data breach compromised customers’ names, addresses, dates of birth, Social Security numbers, Visa credit card numbers and financial account numbers, according to the Via Credit Union class action.
Plaintiffs argue that Via Credit Union failed to properly monitor the computer network and systems that housed the private information exposed in the data breach.
“Had Defendant’s employees (presumably in the IT department) properly monitored its property, it would have discovered the intrusion sooner,” the Via Credit Union class action says.
Runyan claims Via Credit Union is guilty of negligence, negligence per se and breach of implied contract under violation of the Federal Trade Commission Act and Indiana State laws.
He demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, consequential, nominal and punitive damages for himself and all class members.
Customers filed a similar class action lawsuit against TD Bank earlier this month over claims the bank failed to safeguard sensitive customer data during a nearly five-month-long data breach in 2022.
