A new class action lawsuit alleges Vexus Fiber misleads consumers about the cost of its broadband internet service by charging a “junk fee” for access to its network.
Plaintiff Colin LaCrue filed the class action complaint against Vexus Fiber LLC in a Texas federal court, alleging violations of state and federal consumer laws.
LaCrue alleges Vexus Fiber, a Texas-based internet service provider, deceives consumers by advertising low prices for its broadband internet service and then adding a “Network Access Fee” that inflates the true cost of the service.
The class action lawsuit claims Vexus Fiber’s fee is a mandatory charge that customers cannot opt out of, despite being described as a feature that “provides access to the Vexus network and technology.”
The complaint alleges the fee is simply a way for Vexus Fiber to charge customers more money without providing any additional value in return.
Vexus Fiber class action alleges fee is not disclosed to customers
According to the lawsuit, the fee can represent as much as 33% of the advertised cost of Vexus Fiber’s internet service, depending on the specific plan a customer selects.
The complaint alleges Vexus Fiber fails to adequately disclose the fee in its advertisements, leaving customers to discover the true cost of their internet service only after signing up or receiving their first bill.
LaCrue claims Vexus Fiber’s practice of adding the charge as a separate line item on bills is a “classic example” of a company-imposed “junk fee” and serves solely as a profit generator.
The lawsuit cites recent guidance from the Federal Trade Commission, which has cautioned against “misleading door openers” in internet service advertisements and proposed a rule to require fees like installation, activation, and equipment fees to be included in advertised prices.
LaCrue is looking to represent anyone who held an account for an internet service with Vexus and were charged a Network Access Fee. He is suing for violations of the Texas Deceptive Trade Practices Act and unjust enrichment and seeks certification of the class action, damages, fees, costs and a jury trial.
In 2024, Metronet was hit with a class action lawsuit alleging it uses fictitious low-price advertisements to bait-and-switch consumers into enrolling in its broadband internet service.

I am a vexus customer in LA where they are using these same exact business practices in the state of Louisiana. When I first signed on with Vexus the service was about $65 and no where are you disclosed what that price will climb too. I’m now paying $116 a month which is what the price jumped to after 1 year. They say a lot of things to get you signed up but disclose absolutely nothing that should be to the consumer about when and how the rates will change over time. I’m interested in this lawsuit.
