A new class action lawsuit alleges that UPPAbaby sold defective infant car seats that can cause infants to sit in a C-shaped position, potentially leading to airway constriction and other life-threatening conditions.
Plaintiff Theresa Jacobs filed the class action lawsuit against Monahan Products, doing business as UPPAbaby, in New Jersey federal court. The class action lawsuit alleges violations of state and federal consumer laws.
Jacobs alleges that UPPAbaby infant car seats have a dangerous design defect that causes infants to sit in a curved or C-shaped position with their chins close to their chests, resulting in visible signs of distress, such as drooling, choking, crying and excessive sweating.
In some cases, this position can lead to life-threatening conditions, such as airway constriction, Jacobs claims.
Jacobs says she purchased an UPPAbaby Aria car seat in December 2024 for her grandson after conducting extensive research to ensure it was a safe choice.
However, she says she discovered that the car seat forced her grandson into a chin-to-chest position that caused him discomfort and potentially dangerous breathing difficulties.
Jacobs alleges UPPAbaby knew about the design defect but failed to warn consumers.
UPPAbaby allegedly ignored consumer complaints, failed to recall defective car seats
Jacobs claims UPPAbaby received numerous consumer complaints and requests for replacement seats due to the design defect but continued to sell the car seats without disclosing the issue.
She says UPPAbaby even removed one of the defective car seats, the Mesa Max, from the market without acknowledging the true reason for the withdrawal.
Jacobs seeks to represent a nationwide class of consumers who purchased UPPAbaby Aria, Mesa V2 or Mesa Max infant car seats from February 2023 to the present. She also seeks to represent a subclass of New Jersey consumers.
The lawsuit asserts claims for violations of the New Jersey Consumer Fraud Act, fraud by omission or fraudulent concealment, breach of express and implied warranties, violation of the Magnuson-Moss Warranty Act and unjust enrichment.
Jacobs is seeking damages, including treble damages, attorneys’ fees and costs.
In June, several consumers filed a class action lawsuit against Monahan Products for the same reason, selling car seats that put infants at risk of asphyxiation.
