Unum Life Insurance Company of America is facing a new claim denial lawsuit, from an Arkansas woman alleging the insurance company illegally denied her claim for benefits.
The woman alleges Unum had wrongfully denied her claim for benefits with little to no grounds, and had dismissed relevant medical testimony proving her eligibility.
Plaintiff Angela D. is filing this claim denial lawsuit against Unum, after the company allegedly denied her disability benefits despite meeting all requirements.
Before she filed for benefits, Angela had participated in an employee benefit plan that would guarantee long term or short term disability insurance coverage if ever needed.
Angela had made the claim for benefits under the policy, in which she had met all requirements sometime after March 01, 2013.
Initially Angela was approved for disability coverage, but was later denied allegedly based on the same medical conditions.
Previously Angela had been fully employed, was working on a daily basis and regularly completing occupational duties.
Allegations of Unfair Denial of Claim for Benefits
According to her claim denial lawsuit, Angela is disabled due to a number of medical conditions including: Sill’s disease, rheumatoid arthritis, osteoarthritis, fever, chronic pain, migraines, and insulin dependent diabetes.
Under these medical conditions, Angela was unable to work and could not continue using her skills in a similar profession. In addition, Angela has lost a significant amount of her income due to medical expenses and has been unable to earn sufficient income.
Based on the severity of her medical condition and her inability to work, Angela had filed a claim for benefits with Unum. During all times of the filing process, Angela had filed all relevant medical documentation and testimony while following administrative procedure.
Even though she was diligent in following the claim submission instructions and confirming that she was eligible for benefits, Angela was still denied disability benefits.
As mentioned before, Unum had initially approved Angela’s claim for benefits but had later reversed their decision.
Angela alleges that Unum had reversed their decision based on the same information she had submitted with her claim, which proved not only was she eligible but that she needed disability coverage.
Furthermore, Angela claims that Unum had denied her claim for benefits based on insufficient evidence and has been firm in its decision to deny her disability coverage.
Angela has exhausted all administrative remedies and is filing legal action for all missed disability payments, along with any other relevant damages.
The Unum Claim Denial Lawsuit is Case No. 16-5335, in the U.S. District Court for the District of Arkansas, Fayetteville Division.
