Uber Technologies is facing a new class action lawsuit alleging it misleads consumers about Uber arrival times for its rideshare services.
Plaintiff Lucy Ye filed the class action complaint against Uber Technologies on Feb. 27 in California federal court, alleging violations of state consumer laws.
According to the class action lawsuit, Uber advertises its rideshare services with precise Uber arrival times, creating the impression that customers will be picked up at the time promised. However, the lawsuit claims that Uber frequently fails to deliver on this promise, leading customers to pay a premium for a service they do not receive.
Ye alleges that Uber’s app displays arrival times to the minute, such as “3 min,” for its UberX option, which is often preselected and labeled as “Faster” than other options like Wait & Save.
The lawsuit says this leads consumers to believe that they are paying for a faster service. However, Uber’s rides often take as long as or longer than the Wait & Save option, the lawsuit claims.
Uber knowingly misrepresents arrival times, class action alleges
Ye claims that Uber’s misrepresentation of Uber arrival times is not accidental but rather a calculated move to extract a price premium from customers.
She alleges that Uber tailors its arrival times and prices to make certain options appear faster, even when they are not.
The class action lawsuit claims Uber’s app does not provide any disclaimer about the imprecision of its arrival times, further misleading consumers. Ye also claims Uber’s failure to offer refunds for late arrivals adds to the company’s unjust enrichment.
She wants to represent anyone in the United States who paid for a ride advertised as “Faster” or with a specific arrival time but were not picked up within the advertised time.
Ye is suing for violations of California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act as well as for unjust enrichment and fraud.
She is seeking certification of the Uber class action, damages, fees, costs and a jury trial.
In other recent Uber news, a federal jury in Arizona awarded an Uber passenger $8.5 million after finding the rideshare company liable for the actions of a driver who allegedly sexually assaulted her.
