Eliquis Fatal Internal BleedingTo date, thousands of plaintiffs have filed personal injury lawsuits against the makers of popular blood thinners Pradaxa and Xarelto based on claims that these companies failed to adequately warn of serious and potentially fatal internal bleeding side effects.

Now, two surviving spouses have joined together to file a wrongful death lawsuit against the makers of a related drug, Eliquis, also based on claims of Eliquis fatal internal bleeding.

The new Eliquis lawsuit filed in California Superior Court on Oct. 5 by plaintiffs Richard F. and Jean K. claims that use of the medication directly resulted in the untimely death of their spouses after they suffered Eliquis fatal internal bleeding.

The blood-thinning drug has been marketed aggressively by the pharmaceutical industry despite the fact that no reversal agent currently exists to treat adverse incidents with the medication leading many to severe injury and death, the lawsuit states.

Lawsuit Alleges Eliquis Fatal Internal Bleeding

Decedent Marjorie F. ingested Eliquis upon direction of her physician because of a diagnosis of atrial fibrillation. On October 13, 2014, Marjorie suffered alleged Eliquis fatal internal bleeding, specifically right adrenal hemorrhage.

Richard F. of San Diego is the surviving spouse of Marjorie and is filing this Eliquis fatal internal bleeding lawsuit as a survival action on behalf of his late wife’s estate.

Similarly, decedent James K. was diagnosed with atrial fibrillation and was prescribed Eliquis as a treatment for his condition. On October 7, 2014, James suffered alleged Eliquis fatal internal bleeding, specifically a gastrointestinal hemorrhage that resulted in shock with multi-system organ failure.

His wife, Jean K. of Ohio asserts causes of action for James’ wrongful death as his personal representative.

In their joint lawsuit, both Jean and Richard allege that Bristol-Myers Squibb fraudulently neglected to report accurate results from their ARISTOTLE clinical trial while attempting to gain FDA approval for Eliquis.

“Instead of admitting the major errors and frauds involved in the ARISTOTLE study, defendants misleadingly stated publicly that they were submitting ‘additional data’ to the FDA, and to this date have never publicly acknowledged the missing and incorrect data submitted to the FDA, which would be of concern to prescribing physicians and the public,” the lawsuit reads.

Both plaintiffs are seeking compensatory, economic, wrongful death and survival damages as well as punitive damages for the drug maker’s “wanton, willful, fraudulent, reckless acts…complete disregard and reckless indifference for the safety and welfare of the general public.”

A jury trial has been requested in this case.
