Plaintiff Valerie Haley claims Tommy Bahama sends spam emails to Washington consumers with subject lines that create a false sense of urgency to compel them to make purchases.
“Tommy Bahama is practiced in this trick of luring in consumers through urgent subject headings in emails that do not reflect the true availability of the deal itself,” the Tommy Bahama class action lawsuit says.
Haley argues Tommy Bahama’s use of the tactic is in violation of Washington’s Commercial Electronic Mail Act (CEMA), which prohibits the transmission of a commercial email with “false or misleading information in the subject line” to the email address of a Washington resident.
Haley wants to represent a nationwide class of consumers who received an email from Tommy Bahama with a subject line that contained false or misleading statements.

Haley claims Tommy Bahama’s emails falsely narrow the field of competitive products and deals by manipulating consumers into making a decision to purchase its products without considering other options.
“False time scarcity claims thus harm consumers by manipulatively distorting their decision-making to their detriment—and the seller’s benefit,” the Tommy Bahama class action lawsuit says.
Haley claims Tommy Bahama is guilty of violating the Washington Consumer Protection Act. She demands a jury trial and requests declaratory and injunctive relief and an award of actual, statutory and punitive damages for herself and all class members.
Earlier in September, two groups of consumers filed separate class action lawsuits against Macy’s Retail Holdings LLC and Discount Tire Co., accusing the companies of sending deceptive promotional emails to Washington residents.
