Ticketmaster, Live Nation “Paperless Ticket” Class Action Lawsuit

Live Nation TicketmasterLive Nation and Ticketmaster have been hit with yet another class action lawsuit, this time by a Plaintiff claiming the companies violated New York state law by only offering paperless tickets that are nontransferable.

Plaintiff Joshua Fogel alleges in the Live Nation/Ticketmaster class action lawsuit that he purchased tickets for a Swedish House Mafia event on December 16, 2011 and was told that he would have to pick up the ticket at the Will Call Office on the night of the show. He was also told that only he would be able to pick up the ticket, and that “there will be no refunds issued if you are unable to attend.” No other option was provided to him other than the paperless ticket.

This violates the Arts and Cultural Affairs Law of New York (ACAL), he claims in the class action lawsuit.

According to the class action lawsuit, Live Nation and Ticketmaster violated the ACAL by employing a paperless ticketing system for New York events that did not provide the consumer with either “an option to purchase paperless tickets that the consumer could transfer at any price, and at any time, and without additional fees” or “an option at the time of initial sale to purchase the same tickets in some other form that is transferrable.”

The Live Nation paperless ticket class action lawsuit is brought on behalf of all New York, New Jersey or Connecticut residents who purchased “will call only” tickets to specific New York events between July 2, 2010 and January 26, 2012. It is seeking damages of at least $50 for each ACAL violation per Class Member.

The Ticketmaster/Live Nation Paperless Ticket Class Action Lawsuit case is Fogel v. Live Nation Entertainment, Inc., Case No. 12-cv-6816, U.S. District Court, Southern District of New York.

    Live Nation has done this to me multiple times. I want to give my tickets as gifts but because they are non-transferable I have lost a lot of money.
