Ticketmaster Agrees to $23M Class Action Settlement
By Mike Holter
UPDATE: Details on how to file a claim for the Ticketmaster Entertainment Rewards Class Action Lawsuit Settlement are up!
Ticketmaster LLC has agreed to pay $23 million to settle two class action lawsuits accusing the company of enrolling customers without their permission into an online rewards program that charged a recurring monthly fee. Class Members will receive up to $30 in refunds if the Ticketmaster class action settlement is approved.
Plaintiffs John Mancini and Craig Johnson sued Ticketmaster for allegedly violating state competition and consumer laws as well as the federal Electronic Funds Transfer Act by failing to properly disclose that customers would be charged $9 a month if they enrolled in the “Entertainment Rewards” discount coupon program. Mancini and Johnson further alleged that nearly every user failed to gain any benefit from the program.
The parties petitioned the court to preliminarily approve the class action lawsuit settlement as well as a settlement class defined as all persons who made a purchase in the United States on the Ticketmaster.com website between September 27, 2004 and June 9, 2009 and (a) became enrolled in the “Entertainment Rewards” discount coupon program via a process that included Ticketmaster’s transfer of their credit or debit card information, (b) were subsequently charged for their membership in the program, (c) did not receive a full refund of the amounts charged, and (d) as of the Preliminary Approval date have not printed any coupon or applied for any cashback award in connection with the Entertainment Rewards program.
Ticketmaster does not admit wrongdoing under the proposed settlement.
A preliminary approval hearing is scheduled for February 4, 2013.
The Ticketmaster Entertainment Rewards Class Action Lawsuit Settlement cases are John Mancini, et al. v. Ticketmaster, et. al., Case No. 2:07-cv-01459 and Craig Johnson, et al. v. Ticketmaster, et al., Case No. 2:08-cv-07509. Both cases are in the U.S. District Court for the Central District of California.
