benicar-olmesartanA Texas man and his wife have filed a Benicar HCT lawsuit against drug manufacturers Daiichi Sankyo and Forest Laboratories alleging that the dugs Benicar and Benicar HCT caused the husband to suffer serious injuries requiring hospitalization.

Plaintiff John W. and his wife Patricia allege that John began taking Benicar and/or Benicar HCT in approximately 2007 when he was approximately 64 years old. John states that the damage he suffered as a result of taking the Benicar products, including personal injury, economic loss, loss of services and loss of consortium (companionship with spouse).

According to the Benicar HCT lawsuit, John suffered from “severe intestinal and/or colonic disease manifestations, including but not limited to villous atrophy and or/intestinal malabsorption, which resulted in Plaintiff suffering from chronic diarrhea, rapid and severe weight loss, malnutrition, nausea, vomiting, dehydration, anemia and cataracts.”

The lawsuit also indicated that “Plaintiff was hospitalized and lost earnings as a result of these injuries.”

John and Patricia have brought forth a total of seventeen counts against the pharmaceutical companies including product liability claims (design defect and failure to warn), several counts of negligence, fraud, breaches of express and implied warranties, violation of Texas consumer protection law, loss of consortium, and violation of New Jersey’s Product Liability Act.

The couple is seeking relief and judgment against Daiichi Sankyo and Forest Laboratories and hope to recover compensatory damages, punitive damages, interests, costs of litigation and other relief as deemed proper by the court.

The Benicar HCT Lawsuit is Case No. 1:15-cv-08787-RBK-JS in the U.S. District Court District of New Jersey Camden Vicinage and the Benicar MDL is In Re: Benicar (Olmesartan) Products Liability Litigation, MDL No. 2606.

Severe Side Benicar Side Effects

Benicar (olmesartan) is prescription drug used to assist individuals in lowering their blood pressure. However, many users of the medication have reported serious side effects with its use. Nearly every serious side effect of Benicar affects the body’s gastrointestinal system.

The most common side effect of Benicar is diarrhea. Benicar diarrhea is different from the condition that is commonly experienced with other medications as a side effect. In addition to the chronic diarrhea, conditions that mimic Celiac disease are often a common side effect of Benicar. These conditions include sprue-like enteropathy and villous atrophy. These conditions can also further lead to malnutrition and malabsorption of nutrients.

Many patients with Benicar side effects such as these must be stabilized in a hospital setting until they can begin to tolerate food again and process nutrition well enough to sustain themselves. However, the challenges resulting from the Benicar side effects may persist long after the patient is released from the hospital, potentially causing lifelong damage to the gastrointestinal system that must be managed.
