An Axiron testosterone product lawsuit has been filed against Eli Lilly Co. by a male consumer who claims he experienced severe and life-threatening side effects from using the pharmaceutical company’s brand name testosterone gel.

On Oct. 6, plaintiff James A. Foley filed this Axiron lawsuit after he allegedly experienced severe and negative testosterone product side effects he claims were directly caused by his use of the testosterone gel product.

Foley was 70 years old when he was prescribed Axiron by his primary care physician in April 2011. Foley continued to use Axiron as prescribed until around August 2012 to treat symptoms Foley attributed to a low testosterone (or low-t) condition based on Eli Lilly’s Axiron advertisements.

However, On Oct. 11, 2012, Foley was diagnosed with both a pulmonary embolism and deep vein thrombosis for which he was hospitalized. Because of these two serious conditions, Foley will allegedly have to take medication for the rest of his life.

Additionally, “due to his severe clotting events, he is now at markedly increased risk of additional cardiovascular disease, cerebrovascular accidents, and death,” according to the Axiron testosterone products lawsuit.

Foley and his legal counsel claim that had Eli Lilly fully disclosed all the risks and testosterone product side effects, he would not have used Axiron in the first place, limited the dose and length of use of the testosterone product, and/or closely monitored the effects of Axiron on his health in order to avoid the risk of developing a pulmonary embolism and deep vein thrombosis.

In this Axiron testosterone product lawsuit, Foley brings several allegations against Eli Lilly, including claims of strict product liability, failure to warn, negligence, breach of implied warranty, breach of express warranty, fraud, and negligent misrepresentation.

The Axiron Testosterone Product Lawsuit is Foley v. Eli Lilly Co., et al., Case No. 0:14-cv-04149-PJS-TNL, in the U.S. District Court for the District of Minnesota.

Testosterone Product Side Effects

Testosterone products like Axiron have been aggressively marketed to middle aged men who are experiencing the natural decrease in testosterone levels as they age, which may result in loss of muscle mass and a decreased sex drive.

Eli Lilly and other testosterone product manufacturers allegedly use marketing and advertisement pieces to oversell the potential low testosterone side effects and over emphasize their testosterone products’ success in treating these low-t side effects by promising male consumers increased sex drives and vitality.

However, Axiron, AndroGel, and other testosterone products and testosterone shots have some serious risks and side effects.

Some serious testosterone product side effects include:

• Blood clot
• Enlarged prostrate
• Heart attack
• Stroke
• Death

There have been recent studies reporting that spouses and children of AndroGel users allegedly experienced secondary exposure to the testosterone products. In response to these reports, the U.S. Food and Drug Administration (FDA) issued a black box warning in 2009 for all testosterone product prescriptions and advised patients that there had been many reports of virilization of children through secondary exposure to Axiron and other testosterone gels and creams.

The FDA also warned pregnant women of the possible physical changes they might experience from secondary testosterone exposure and reports of fetal damage allegedly caused by testosterone product exposure.

Foley is not the only individual pursuing a testosterone product lawsuit. Many consumers and their families are filing Axiron testosterone product lawsuits or joining testosterone product class action lawsuits.
