TD Bank fee class action lawsuit overview:

TD Bank charges its New York customers an unlawful fee to receive account billing statements in paper form through the mail, a new class action lawsuit alleges.

Plaintiff Joshua Hastings claims TD Bank charges a monthly fee for its customers to receive a paper billing statement despite the fact that New York state law prohibits companies from doing so.

“By setting out the fees that TD Bank charges consumers, the Account Statements that TD Bank issues constitute ‘paper billing statement[s]’ under the New York General Business Law,” the TD Bank class action lawsuit states. 

Hastings wants to represent a class of New York residents who were charged a fee to receive their account statements in paper form by TD Bank.

TD Bank charges $3 fee for each paper billing statement, class action says

TD Bank charges a $3 fee for each paper billing statement, according to Hastings, who argues the alleged fee not only violates New York law but also unfairly impacts certain consumers. 

“Paper billing and payment fees unfairly impact consumers that do not have Internet access in their homes, as well as those that are uncomfortable using the Internet, including many senior citizens and those concerned about personal privacy,” the TD Bank fee class action says.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, exemplary, statutory, incidental, consequential, actual and punitive damages for himself and all class members.

A consumer filed a separate class action lawsuit against TD Bank earlier this year over claims the bank improperly charged cash advance fees for transactions that were not cash advances.

In February, a consumer filed a class action lawsuit against TD Bank over claims it failed to properly safeguard sensitive customer data during a nearly five-month-long data breach in 2022.
