A new class action lawsuit alleges TD Bank failed to properly safeguard sensitive customer data from a data breach that occurred when an employee allegedly obtained unauthorized access to customer information.
Plaintiff Earl Crumpe’s Feb. 28 class action lawsuit claims TD Bank allowed a former employee to gain unauthorized access to its network for nearly five months, from August to December 2022.
Crumpe argues the employee acquired information, such as names, contact information, dates of birth, account numbers and transactional data.
“Because this Data Breach targeted financial and personally identifying information, it is reasonable to infer that the hackers will use victims’ data for fraudulent purposes, including identity theft,” the TD Bank class action says.
TD Bank failed to implement reasonable data security measures, class action claims
Crumpe claims TD Bank failed to implement reasonable data security measures to protect against unauthorized access to sensitive customer information, despite allegedly having knowledge of the potential risk.
According to the lawsuit, TD Bank has a history of similar issues. In 2024, Crumpe says the bank issued two different data breach notices regarding incidents in which an employee improperly obtained access to customer data.
“As such, it is clear that TD Bank has a systemic problem with securing its consumer data,” the lawsuit states.
Crumpe argues TD Bank violated the Federal Trade Commission Act and is guilty of negligence, negligence per se, breach of implied contract and unjust enrichment.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory damages for himself and all class members.
In September 2024, the Consumer Financial Protection Bureau ordered TD Bank to pay a $28 million fine over claims the bank knowingly reported inaccurate information about consumer accounts to credit reporting agencies.

I have been hacked at TD Bank more then I care to say. Im literally sitting in the bank as I type this becuse there are more charges that are not mine. A lady before me just shut her account down. I have NEVER had issues with any bank but this one! It’s ridiculous. Ive closed my account and reopened a new one giving them another chance. But im done!! Something needs to be done!! I did not know there was a data breach, but from 2022 to 2023 my account was hacked numerous times. Once to the point where I had to close my account. Without me telling them they had my name, phone number, account number and birthday. It was brushed off as scammers and implied it was related to the Internet.Thankfully the money was returned but it was always implied if not explicitly said that it was my fault because of “online shopping,” even though I hardly did any online shopping at that point, and they would just kind of shrug and say stuff happens.
