TD Bank failed to properly secure and safeguard the personally identifiable information (PII) of its customers during a 2023 data breach, a new class action lawsuit alleges.
Plaintiff Robert Taylor’s class action lawsuit claims a TD Bank employee improperly accessed the personal information of some of the bank’s customers between May and October 2023 and may have provided it to an unauthorized third party.
Taylor argues this alleged improper access and potential sharing exposed TD Bank customers’ names, addresses, phone numbers, Social Security numbers, dates of birth, transaction data and account numbers stored within the bank’s information network.
“Representative Plaintiff and Class Members have suffered and will continue to suffer the continued risks of exposure of their Private Information,” the TD Bank class action claims.
Taylor wants to represent a nationwide class of individuals whose PII was exposed to unauthorized third parties as a result of the TD Bank data breach announced by the bank on or about Feb. 1, 2025.
TD Bank failed to inform victims of data breach for months, class action alleges
Taylor claims TD Bank failed to inform the victims of the data breach until February 2025, even though the bank knew about it for some time.
“Representative Plaintiff and Class Members were wholly unaware of the Data Breach until they received letters from Defendant informing them of it,” the data breach class action says.
Taylor claims TD Bank is guilty of negligence, breach of implied contract and breach of the implied covenant of good faith and fair dealing.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual, nominal and consequential damages for himself and all class members.
The Consumer Financial Protection Bureau ordered TD Bank to pay a $28 million fine last year over claims the bank knowingly reported inaccurate information about consumer accounts to credit reporting agencies.
