A new class action alleges that TD Bank unlawfully shared its customers’ personal information with Meta — the owner of Facebook and Instagram — for marketing purposes.
Plaintiff Jeffrey Stevens filed the class action complaint against TD Bank NA on Aug. 6 in a New Jersey federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, TD Bank incorporated Meta’s tracking code, known as the “Facebook Tracking Pixel,” into its website, allowing Meta to collect customer data without their consent.
“Meta combines this personal information with other information about each consumer gathered from other sources and uses it for marketing and advertising purposes,” the lawsuit says.
TD Bank lawsuit alleges violations of federal law
The tracking code enabled Meta to gather information about customers’ interactions with TD Bank’s website, which was then used to create custom audiences for TD Bank’s marketing campaigns, the lawsuit states.
This data sharing benefited both TD Bank and Meta, with Meta using the information to enhance its own products and services, Stevens claims.
Central to the lawsuit is the accusation that TD Bank violated the Gramm-Leach-Bliley Act, a federal law that prohibits financial institutions from disclosing a consumer’s personally identifiable financial information without proper notification and the opportunity to opt out.
According to the complaint, the shared data included sensitive information related to applications for credit cards and other financial products.
Stevens claims that TD Bank failed to provide clear and accurate notice to its customers regarding its data-sharing practices.
The lawsuit points out that TD Bank’s privacy policy falsely claimed that the bank does not share customers’ personal information with non-affiliates for marketing purposes.
This alleged misrepresentation shows the bank acted negligently and breached its agreement with customers, the lawsuit claims.
As a result, Stevens looks to represent a nationwide class of people who had a Facebook account and interacted with TD Bank’s online financial platform.
He is suing for negligence, unjust enrichment, and breach of contract and is seeking certification of the class action, damages, fees, costs and a jury trial.
Meanwhile, in June, a federal judge gave initial approval to a $32.2 million settlement between TD Bank and its customers over overdraft fees.
