
TCL class action lawsuit overview:

A new class action lawsuit accuses TCL of falsely advertising that certain models of its televisions contain QLED technology.
Plaintiff Stephan Herrick claims TCL advertises that certain models of its televisions contain QLED technology despite knowing that they do not contain the technology or contain it in such minimal amounts that it does not meaningfully contribute to the performance or display output of the television.
“As a result of TCL’s unfair, deceptive and/or fraudulent business practices, owners of TCL QLED televisions, including Plaintiff, have suffered ascertainable losses,” Herrick alleges in the TCL class action lawsuit.
Herrick wants to represent a California class of consumers who purchased a TCL television advertised and labeled as having a QLED or QD-Mini LED display.
TCL consumers paid premium price for TVs, class action alleges
Herrick claims consumers paid a premium price for TCL televisions advertised as having QLED technology. He claims he paid $329.24 for a TCL QLED TV in July 2024 after viewing advertising on Amazon and TCL’s website stating that the TV was a QLED television.
Herrick argues he paid more for the TCL television than he would have paid if the TV did not have the QLED deficiency and TCL’s advertising had been truthful.
The TCL class action lawsuit asserts claims for violations of California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act as well as unjust enrichment, fraud and negligent misrepresentation.
Herrick is seeking certification of the class action, compensatory damages, punitive damages, restitution, disgorgement, injunctive relief and an award of attorneys’ fees and costs.
In 2022, TCL agreed to a $2.9 million settlement to resolve a class action lawsuit alleging the company marketed its TV models with inflated refresh rates.
