StubHub class action lawsuit overview:

StubHub Holdings is facing a new class action lawsuit that claims the ticket seller fails to honor its 100% ticket guarantee.

Plaintiff Alexis Christensen filed the class action complaint against StubHub on Oct. 9 in Washington federal court, alleging violations of state and federal consumer laws.

According to the lawsuit, StubHub misleads consumers with its “FanProtect Guarantee,” promising tickets will be delivered on time, valid for entry and comparable to those ordered, or else a full refund will be provided.

However, the lawsuit claims StubHub often fails to honor this guarantee, providing inferior tickets or refusing refunds even when better tickets are available on its platform.

The suit cites numerous complaints to the Better Business Bureau, alleging StubHub’s “routine” failure to fulfill its promises.

StubHub charges fees to both buyers and sellers on its platform, purportedly to support the FanProtect Guarantee, the class action lawsuit says. However, Christensen claims StubHub profits by charging consumers a premium for a guarantee it does not uphold.

Christensen says she purchased three tickets for Taylor Swift’s Eras Tour for about $14,000 through StubHub, only to be given inferior tickets just before the concert when her original tickets were unavailable.

Despite finding comparable tickets herself, Christensen claims StubHub refused to provide them, forcing her to use the inferior seats.

StubHub allegedly retains full purchase price even when tickets unavailable

The class action lawsuit alleges that StubHub retains the full purchase price from buyers and charges sellers when tickets are unavailable, profiting from fees on both sides of the transaction without honoring its guarantee.

Christensen seeks to represent anyone who purchased tickets through StubHub in the United States within the applicable statute of limitations period.

She is suing for violations of Washington’s consumer protection laws, intentional misrepresentation, common law fraud, fraudulent inducement and unjust enrichment and seeks certification of the class action, damages, fees, costs and a jury trial.

In 2024, StubHub was sued for allegedly violating the Americans with Disabilities Act by failing to make its website fully accessible to people who are blind or visually impaired.
