A new class action lawsuit alleges Target failed to include required disclosures on the packaging of iPhones it sold.
Plaintiff Jesika Brodski filed the lawsuit against Target on May 7 in Washington state court, alleging violations of state consumer protection laws.
According to the class action lawsuit, Target failed to disclose required information on the packaging of iPhones, including repair responsibilities, standard repair charges and warranty terms.
The plaintiff claims this lack of information misled consumers and violated Washington’s Telephone Buyers’ Protection Act (TBPA) and Consumer Protection Act (CPA).
The TBPA, enacted in 1984, mandates that sellers of telephone equipment, including iPhones, must clearly disclose specific information before sale, such as the person responsible for repairs, standard repair charges and warranty terms, the lawsuit states.
Target’s alleged omissions deceptive, plaintiff says
Target allegedly failed to provide required information on the packaging of iPhones, leading to consumer deception, the lawsuit claims.
Brodski, who purchased an iPhone from a Target store in Washington, says she was deceived by Target’s alleged unlawful conduct. She claims she would not have purchased the iPhone, or would have paid less for it, had the required disclosures been made.
The lawsuit asserts that Target’s failure to disclose the required information constitutes a per se violation of the CPA, which makes it unlawful to commit unfair or deceptive acts or practices in the conduct of any trade or commerce.
The class action lawsuit seeks to represent a class of all persons who purchased the iPhones for personal use in Washington within the applicable statute of limitations.
The plaintiff seeks an order certifying the Target iPhone class action lawsuit, actual and statutory damages, attorneys’ fees and costs and pre- and post-judgment interest.
In April, Costco was slapped with a lawsuit alleging it failed to include certain required repair and warranty information on the packaging of iPhones sold at its retail locations.
