Tadin Inc. has agreed to settle a class action lawsuit alleging it made false and misleading claims about some of its products. If you purchased certain Tadin products between Dec. 21, 2008 and June 21, 2014, your rights could be affected by the class action settlement.
The Tadin tea settlement will resolve a class action lawsuit alleging the company misled consumers regarding its weight loss teas and dietary supplements. The plaintiffs alleged the company misrepresented the benefits and abilities of its products and breached express and implied warranties regarding its products. Tadin denies the allegations and continues to stand by its products and advertising.
Class Members of the Tadin class action settlement include all U.S. consumers who purchased one or more of the following products for household or personal use from Dec. 21, 2008 through June 21, 2014:
- Zendo Dieters Tea
- Zendo Extra Fuerte (Extra Strength) Dieters Tea
- Zendo Dieters Tea Capsules
- Slim-Mate Tea
- Alcachofa (Artichoke) Extra Tea
- Alcachofa (Artichoke) Capsules
- Alcachofa (Artichoke) Extra Capsules
- Aloe Vera with Cactus (Sabila Con Nopal) Tea
- Aloe Vera with Cactus (Sabila Con Nopal) Capsules
- Manzanilla Tea
- Manzanilla con Anis Tea
- Manzanilla con Menta Tea
- Tila Tea
- Siete Azahres Tea
- Te de Limon
- Yerbabuena Tea
- Bronco Tea
- Linaza Extra
- Alcachofa con Linaza
- Nopal Capsules
The Tadin tea class action settlement, which was approved in April, will provide injunctive relief by modifying the labeling and packaging of the affected products. The Tadin settlement does not provide monetary relief because Tadin has already agreed to modify its packaging to remove the concern of false and misleading advertising. Under the Consumer Legal Remedies Act (CLRA), these modifications would have precluded a damages award at trial.
Under the terms of the Tadin class action settlement, Tadin has agreed to add a disclaimer to its products and product-specific webpages indicating that the U.S. Food & Drug Administration has not evaluated the statements on the labels and clarifying that the products are not meant to prevent, diagnose, treat or cure any diseases. Further, it will remove the allegedly false and misleading statements and images from its products and other advertising materials.
Class Members who wish to object to or exclude themselves from the Tadin class action settlement must do so by June 21, 2014. Class Members who do nothing will be part of the Tadin settlement, if approved, and will release all claims asserted in the class action lawsuit. A final approval hearing for the Tadin class action settlement will be held on July 21, 2014.
