A new class action lawsuit claims Wisdom Natural Brands misleads consumers about the ingredients in its SweetLeaf Monk Fruit Organic Sweetener.
Plaintiff John Boyd claims Wisdom Natural Brands falsely advertises the product as a monk fruit sweetener that contains “nothing artificial” and is “sweetened by nature” despite the product containing less than 1% monk fruit extract.
Boyd argues the product is primarily sweetened with the artificial sweetener erythritol, which he claims is a chemically processed sugar alcohol with known health risks, including heart attack, stroke and digestive issues.
“Consumers are being deceived and overcharged,” the SweetLeaf class action lawsuit says.
Boyd wants to represent a nationwide class and California subclass of consumers who bought SweetLeaf Monk Fruit Organic Sweetener for personal and household use and not for resale within the applicable statute of limitations.
Lab tests reveal ‘SweetLeaf Monk Fruit Organic Sweetener is 99.13% erythritol’
Boyd claims Wisdom Natural Brands uses erythritol as a bulk filler and adds less than 1% of monk fruit extract to the product to boost sweetness while marketing it as a natural monk fruit sweetener.
“Despite being labeled as a ‘monk fruit’ sweetener, the product’s rear label ingredient list reveals that erythritol is the most prominent ingredient in the product,” the SweetLeaf class action lawsuit says.
Boyd argues independent laboratory testing commissioned by his counsel found the product contains 99.13% erythritol and only 0.87% monk fruit extract.
He claims the alleged misleading advertising allows Wisdom Natural Brands to charge a premium for the product while cutting costs and reaping financial benefits from selling a product with almost no natural monk fruit.
The class action lawsuit claims Wisdom Natural Brands is guilty of breach of express and implied warranties, negligent and intentional misrepresentation, fraud, unjust enrichment and violations of California’s consumer protection laws.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory and punitive damages for himself and all class members.
Last year, Nature’s Own was hit with a lawsuit over claims it falsely advertises its bread as free from artificial preservatives, even though the bread contains ascorbic acid.
