A California consumer has filed a class action lawsuit against Sprouts Farmers Market Inc. and EcoSoul Home Inc., claiming the companies falsely advertised their disposable tableware products as compostable when they actually contain harmful substances.
Plaintiff Randy Tyndall filed the class action lawsuit against Sprouts Farmers Market and EcoSoul Home on Jan. 10 in California federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, Sprouts and EcoSoul market and sell disposable single-use tableware, such as plates, bowls, cups, straws and cutlery sets, under the Sprouts brand name, claiming they are compostable.
The plaintiff argues that these products are not compostable because they contain significant amounts of perfluoroalkyl and polyfluoroalkyl substances (PFAS), which do not break down and are harmful to the environment and human health.
Sprouts, EcoSoul misled consumers on eco-friendly products, lawsuit claims
Tyndall says he purchased several products from a Sprouts store, relying on the companies’ representations that they were compostable.
He explains he was willing to pay a premium for the products because he wanted to minimize his impact on the environment.
However, the plaintiff says he later discovered that the products contained PFAS, which are known as “forever chemicals” because they persist in the environment and can cause various health problems.
The class action lawsuit accuses Sprouts and EcoSoul of violating state and federal laws by making false and misleading claims about the compostability of their products.
The plaintiff claims the companies breached express warranties, violated the California Consumers Legal Remedies Act and engaged in unfair competition and false advertising.
The Sprouts class action lawsuit seeks to represent all consumers who purchased the products in California during the applicable statute of limitations period.
Tyndall demands a jury trial and seeks an order enjoining Sprouts and EcoSoul from continuing their allegedly deceptive practices and an award of damages and restitution for the class members.
A consumer filed a class action complaint against The Hershey Co. in December over similar allegations, claiming that the packaging for several of its popular chocolate products contains PFAS.
PFAS can take hundreds or even thousands of years to break down, and at least 45% of U.S. tap water supplies are contaminated with PFAS.

I shop at Sprouts mainly for their relatively healthy pre-made entrees. A few times, I purchased disposable utensils based on its compostability claim and am disappointed they actually contain PFAS.
