A new class action lawsuit alleges Conagra falsely advertises its Snack Pack pudding as preservative-free even though it contains sodium phosphate.
Plaintiff Terrance Wilson filed the class action complaint against Conagra in California state court, alleging violations of state consumer laws.
According to Wilson’s class action lawsuit, Conagra falsely advertises its Snack Pack pudding products as preservative-free despite containing disodium phosphate.
Wilson’s lawsuit alleges that Conagra misled consumers by labeling its Snack Pack pudding products as having “no preservatives” when they actually contain disodium phosphate, a chemical preservative.
The plaintiff claims he purchased Snack Pack pudding based on the “no preservatives” label, believing it to be free of such additives.
However, Wilson says he later discovered that disodium phosphate, an ingredient in the pudding, is used to extend shelf life by inhibiting bacterial growth.
The class action lawsuit claims the U.S. Food and Drug Administration (FDA) defines a chemical preservative as any chemical added to food to prevent or retard deterioration.
Disodium phosphate is used in foods to prevent microbial growth and extend shelf life, the lawsuit states.
Snack Pack class action: Consumers paid premium for preservative-free products
Wilson argues that consumers, including himself, paid a premium for Snack Pack pudding based on the false “no preservatives” claim.
He claims he would not have purchased the product had he known it contained preservatives.
The Snack Pack class action lawsuit alleges that Conagra’s misleading labeling deprived consumers of the benefit of their bargain, as they did not receive the preservative-free product they paid for.
The complaint also claims that Conagra unjustly profited from the false advertising, as consumers paid more for a product they believed to be superior in quality.
Wilson’s class action lawsuit seeks to represent all U.S. consumers who purchased the allegedly mislabeled Snack Pack pudding within the past four years.
He is suing for violations of state consumer laws and seeks certification of the class action, damages, fees, costs and a jury trial.
Similarly, The Kroger Co. recently faced a class action lawsuit alleging it falsely advertised its Simple Truth Fruit & Grain Bars as preservative-free even though they contain citric acid.
