A new class action lawsuit claims SimpliSafe falsely advertises permanent discounts for its home security systems.
Plaintiffs Travis Schlueter-Beckner and Zach Babka filed their class action complaint against SimpliSafe Inc. on Feb. 19 in a California federal court, alleging violations of state consumer protection laws.
“Defendant provides a textbook example of this illegal use of fake or permanent discounts to trick consumers into purchasing its wares,” the SimpliSafe class action lawsuit alleges.
Schlueter-Beckner and Babka claim SimpliSafe advertises discounts off higher reference prices to increase the perceived value of its home security systems to consumers and decrease their desire to search for competing products.
The plaintiffs also claim SimpliSafe further represents that the discounts are temporary to increase a consumer’s sense of urgency to buy the product now rather than later or risk losing the discount.
“While offering legitimate discounts to achieve these results is a valid form of competition, offering fake ones—with fictitious ‘reference prices’ and/or expiration dates—is deceptive, illegal, and harmful to consumers,” the SimpliSafe class action lawsuit alleges.
SimpliSafe discounts violate California law, class action alleges
Schlueter-Beckner and Babka argue SimpliSafe’s discounts for its home security systems violate California’s False Advertising Law (FAL), which they claim prohibits businesses from making statements that they know or should know to be untrue or misleading.
The plaintiffs claim SimpliSafe’s discounts are illusory since the home security systems are always advertised with discounts off higher reference prices.
“Defendant’s sales never end,” the SimpliSafe false discounts class action lawsuit says.
Schlueter-Beckner and Babka want to represent a California class of consumers who purchased one or more of SimpliSafe’s home security systems that were advertised with a discount.
The plaintiffs demand a jury trial and request declaratory and injunctive relief and an award of compensatory, statutory and punitive damages for themselves and all class members.
So far this year, several companies are facing class action lawsuits over false discounts and similar tactics, including Comfrt loungewear products, Nood cosmetics, fashion retailer Hot Topic and Sunglass Hut.
