Silent Snooz False Advertising Class Action Lawsuit

Silent SnoozA class action lawsuit claims the “Silent Snooz” nasal septum ring does not reduce snoring or aid sleep as advertised.

Illinois Plaintiff Justin Swires alleges in the Silent Snooz class action lawsuit that the manufacturer, Incredible Scents, Inc., deceptively fails to disclose, despite representing to the contrary, that Silent Snooz does not reduce snoring and has not been clinically tested, proven or patented to reduce snoring, promote freer breathing, open nasal passages, and facilitate nasal breathing.

“Incredible Scents has no legitimate basis for making any of its efficacy claims, and, thus, such claims are unfair, unjust, and deceptive,” Swires claims in the Silent Snooz class action lawsuit.

The Silent Snooz class action lawsuit is brought on behalf of all consumers who purchased the product from August 30, 2007 to the present. It is seeking restitution and damages for the proposed class for claims of violating consumer protection acts, breach of express warranty and unjust enrichment. The class action lawsuit is also asking that Incredible Scents remove any language from the Silent Snooz packaging that it is clinically tested and proven to reduce snoring and facilitate nasal breathing.

The case is Justin Swires v. Incredible Scents, Inc., Case No. 12-L-453, Circuit Court for the Twentieth Judicial Circuit St. Clair County, Illinois. The Plaintiff and proposed Class are represented by Brian T. Kreisler of The Kreisler Law Firm, LLC and Michael R. Reese of Reese Richman LLP.

    Just as the above comment by Donna Healy, I am now suffering from scar tissue and nose bleeds and it was only used for 3 weeks. My nose has become scarred, bloody and painful to the point of being too painful to touch.

    This product caused me to have problems with the inside of my nose where it rested, 2 years later I still have scar tissue!
