ShellA class action lawsuit claims Shell secretly records calls made to its 888-GO-SHELL customer service number without the callers’ consent or notice, in violation of California’s Invasion of Privacy Act.

The lead Plaintiff in the class action lawsuit says he made five cell phone calls to Shell’s customer service number from March through May 2012 concerning his Shell gift card, during which he shared sensitive personal information, including his name, gift card number and telephone number. During these calls, customer service agents failed to disclose that his phone conversations were being recorded and/or monitored, the class action lawsuit says.

“Defendants’ policy and practice of recording and intercepting telephone conversations without the consent of all parties violates California’s Invasion of Privacy Act, [which] prohibits the recording or intercepting (i.e., monitoring) of a communication made from a cellular or cordless telephone without the consent of all parties to the communication,” the class action lawsuit states.

The class action lawsuit is brought on behalf of all California residents who participated in one or more phone conversations with the Shell Oil central customer service call center from a cell phone or cordless phone located in California, and whose calls were secretly recorded and/or monitored by Shell without disclosure.

It is seeking damages and an injunctive order banning Shell from further violating the Invasion of Privacy Act.

The case is Tuan Nguyen v. Shell Oil Company, et al., Case No. RG12635378, Superior Court of the State of California, County of Alameda.

UPDATE: A settlement was reached in this case and the Court granted preliminary approval to the Shell recording class action settlement on March 25, 2014. The deadline to file a claim was July 1, and a Final Approval Hearing will be held Aug. 26. More information can be found at the Settlement Administrator website: www.ShellRecordingSettlement.com.

    I contacted the attorney’s offices where, after discussing possible action for lack of notice (I too received my postcard on July 5 after the deadline) was told a form would be mailed, even though it was late. I was told several people were in our position, and they would resolve – but time ticks away toward the Fairness Hearing date. It still has not been received, nor any further communication. I am looking to find someone who will take up our cause for this late notification, otherwise I plan to contact my attorney for a legal solution. If I do not receive the claim form shortly, I will be willing to participate in any action against these parties for late disclosure. They told me that they made phone calls from recordings that could have easily been interpreted as a sales call, and I received no such call anyway to my knowledge. I don’t believe we should stand for this! [email protected]

    Case Number 4:12-cv04650-YGR I just received the notice on July 5th and it said the deadline was July 1st, 2014. I would like to be included in this but did not receive the notice until today July 5th. My cell number is *05-441-9256. I did not see a link to file a form.
