Dozens of women have come together to file a lawsuit against Bayer Healthcare over serious Essure system side effects.
Essure is a popular permanent birth control method, approved by the U.S. Food and Drug Administration in 2002.
The Essure device consists of two metal coils which are implanted into a patient’s fallopian tubes.
It takes months following the initial Essure procedure for the coils to become effective, expanding in place and allowing tissue to grow around them.
Eventually, this is intended to completely block the fallopian tubes and prevent any pregnancy.
According to Bayer Healthcare’s advertising and marketing, the Essure coils device is a safe and effective method of permanent birth control.
Bayer Healthcare has continuously marketed Essure as a safer, simpler, and more effective method of permanent birth control than other options currently available to women, plaintiffs claim.
Development of Essure began in 1998 under the watch of Conceptus Inc. The Essure system failure lawsuit alleges that, at the time that Conceptus began pushing Essure, the company was hundreds of millions of dollars in debt.
Plaintiffs claim that debt impacted how heavily Conceptus marketed its product.
Indeed, the Essure lawsuit alleges, the large market of American women undergoing procedures like Essure each year is in the hundreds of thousands. It presented an invaluable business opportunity that could help pull Conceptus out of debt, the plaintiffs claim.
At the time Essure system entered the market, it was Conceptus’ sole product and was therefore entirely responsible for how the company approached its debt problem.
Essure was essential to Conceptus’ future, but the medical community would have an understandable concern about a device that is the first of its kind, the Essure lawsuit claims.
So, “to promote the perceived safety of the device and gain market acceptance, Conceptus devised and implemented a scheme to defraud physicians and patients, by means of false and fraudulent pretenses, representations and concealment of material facts,” the plaintiffs claim.
As a result, Essure was marketed as a simple permanent birth control solution that was safer than its alternatives.
However, the Essure lawsuit claims that Conceptus and Bayer knew of the serious dangers linked to Essure, and the companies allegedly withheld a large amount of safety information pertaining to the system’s risks.
Essure Side Effects
Essure side effects lawsuits allege a number of serious Essure complications, including but not limited to the following:
- device migration
- hysterectomy
- abdominal pain
- pelvic pain
- back pain
- bloating
- weight gain
- heavy menstrual bleeding
- irregular menstrual cycles
- perforated organs
- ectopic pregnancy
Migration of Essure and organ perforation are two of the most dangerous Essure side effects. If the Essure device migrates from its proper location, it can perforate nearby organs, leading to some very dangerous complications.
